Abstract

Abstract

Originally published in 1968. Far from being an isolated outburst of community insanity or hysteria, the Massachusetts witchcraft trials were an accurate reflection of the scientific ethos of the seventeenth century. Witches were seldom hanged without supporting medical evidence. Professor Fox clarifies this use of scientific knowledge by examining the Scientific Revolution's impact on the witchcraft trials. He suggests that much of the scientific ineptitude and lack of sophistication that characterized the witchcraft cases is still present in our modern system of justice. In the historical context of seventeenth-century witch hunts and in an effort to stimulate those who must design and operate a just jurisprudence today, Fox asks what the proper legal role of medical science—especially psychiatry—should be in any society. The legal system of seventeenth-century Massachusetts was weakened by an uncritical reliance on scientific judgments, and the scientific assumptions upon which the colonial conception of witchcraft was based reinforced these doubtful judgments. Fox explores these assumptions, discusses the actual participation of scientists in the investigations, and indicates the importance of scientific attitudes in the trials. Disease theory, psychopathology, and autopsy procedures, he finds, all had their place in the identification of witches. The book presents a unique multidisciplinary investigation into the place of science in the life of the Massachusetts Bay Colony in the seventeenth century. There, as in twentieth-century America, citizens were confronted with the necessity of accommodating both the rules of law and the facts of science to their system of justice.

Connus des Romains selon le Digeste, en place dans les coutumiers médiévaux, imposés par la législation des États absolutistes dans les cas de grossesse illégitime, d’infanticide, d’empoisonnement et de blessures mortelles ou non, devenus routiniers et réglés par des Édits multipliés au temps des Lumières dans le cadre de la justice pénale, les savoirs médico-légaux s’imposent comme la médecine du crime. La médecine légale, qui s’est construite comme une science depuis le XIXe siècle entre la scène du crime, l’université, la morgue, le laboratoire et les cours de justice, a une histoire qui remonte à la Renaissance au moins. En atteste cet ouvrage constitué d’archives. Il donne à lire un corpus inédit d’environ 400 expertises médico-légales que signent au XVIIIe siècle à Genève des chirurgiens et des médecins assermentés en justice. Autour des enjeux judiciaires de l’expertise médico-légale qui limite l’arbitraire du juge, cette documentation permet d’historiciser la fabrique institutionnelle et sociale du savoir médico-légal sur le terrain du crime. L’investigation judiciaire et les expertises médico-légales qualifient et mesurent les conséquences morbides du passage à l’acte suicidaire ou criminel. Par l’objectivation naturaliste des plaies et des traumatismes, les experts mettent en indices judiciaires les corps meurtris.

Abstract

Die Studie behandelt das in der sozialrechtlichen Praxis sehr umstrittene Antragsrecht auf Anhörung eines bestimmten Arztes im sozialgerichtlichen Verfahren (§ 109 SGG). In Prozessen vor den Sozialgerichten wird häufig um komplexe medizinische Fragen gestritten. Daher wird im Rahmen der gerichtlichen Sachverhaltsaufklärung häufig ärztlicher Sachverstand beigezogen. Das Sozialgerichtsgesetz kennt neben der Gutachteneinholung von Amts wegen die Besonderheit der Anhörung eines von der Klagepartei benannten Arztes. Die Arbeit ordnet das Antragsrecht zunächst dogmatisch ein und untersucht insbesondere, welche Zwecke dieses verfolgt, und wie es sich zur gerichtlichen Sachverhaltsaufklärung verhält. Im zweiten, dem empirischen Teil wird auf Basis einer bundesweiten Untersuchung sozialgerichtlicher Verfahren der Frage nachgegangen, ob und in welcher Weise sich die von der Klagepartei veranlassten Gutachten auf den Prozessverlauf und das Prozessergebnis auswirken. Damit ist die Arbeit zugleich ein Beitrag zur Verbindung von Rechtsdogmatik und Rechtstatsachenforschung.

Abstract

Although the discussion of the ethical, legal and medical problems of (late) abortion, prenatal diagnosis and embryopathic findings continues since the reform of the Pregnant Women and Family Welfare Amendment Act of 1995 and the related elimination of embryopathic indication for almost fifteen years, convincing solutions are still missing. This volume contains the contributions of the 3rd Workshop on Medical Law conducted on February 26 2008. They remind of the urgent need for reform and offer suggestions for the legal policy debate. In the focus of the contributions stand the (criminal) legal and medico-ethical "evaluation" of human life before birth and the question of how the involved professionals can handle their responsibility with the issue of a embryopathic findings, to ensure that the pregnant patient receives help and support during her emotionally stressful decision-making process, but also consider the right to life of the unborn child (especially in cases of extra-uterine viable). Obwohl die Diskussion um die ethischen, rechtlichen und medizinischen Probleme des Schwangerschafts(spät)abbruchs nach Pränataldiagnostik und embryopathischem Befund seit der Reform durch das Schwangeren- und Familienhilfeänderungsgesetz von 1995 und der damit verbundenen Abschaffung der embryopathischen Indikation seit bald fünfzehn Jahren geführt wird, fehlen noch immer überzeugende Lösungskonzepte. Die in diesem Band enthaltenen Beiträge des am 26. Februar 2008 veranstalteten 3. Göttinger Workshops zum Medizinrecht mahnen den dringenden Reformbedarf an und bieten Anregungen für die rechtspolitische Diskussion, die vor Kurzem mit einem Gesetzesentwurf aus den Reihen der CDU/CSU-Fraktion zur Änderung des Schwangerschaftskonfliktgesetzes erneut in Gang gesetzt wurde. Im Mittelpunkt der Beiträge stehen die (straf- )rechtliche und medizin-ethische Bewertung menschlichen Lebens vor der Geburt und die Frage, wie die beteiligten Professionen mit der Problematik eines embryopathischen Befundes verantwortlich umgehen können, damit die schwangere Patientin beim emotional belastenden Entscheidungsprozess die notwendige Hilfe und Unterstützung erhält, gleichzeitig aber auch dem Lebensrecht des ungeborenen Kindes (insbesondere in Fällen extrauteriner Lebensfähigkeit) angemessen Rechnung getragen werden kann.

Abstract

When, why and how was it first believed that the corpse could reveal ‘signs’ useful for understanding the causes of death and eventually identifying those responsible for it? The Body of Evidence. Corpses and Proofs in Early Modern European Medicine , edited by Francesco Paolo de Ceglia, shows how in the late Middle Ages the dead body, which had previously rarely been questioned, became a specific object of investigation by doctors, philosophers, theologians and jurists. The volume sheds new light on the elements of continuity, but also on the effort made to liberate the semantization of the corpse from what were, broadly speaking, necromantic practices, which would eventually merge into forensic medicine.
