Abstract

Regulatory reforms have long been a focus for Southeast Asian nations, often as a way to improve the business climate and policy frameworks for trade and investment. The recent COVID-19 pandemic has spurred countries around the world to review and update their regulatory policies to respond to the current crisis and prepare for the next one. This publication presents a snapshot of the current state of regulatory reform across the region, with country profiles from all 10 Member States of the Association of Southeast Asian Nations (ASEAN) highlighting practices in three priority areas: whole-of-government initiatives, good regulatory practices, and use of digital technologies. It also offers an analysis of common themes identified across the profiles, including trends in regulatory reform, common challenges faced by countries, and future priorities in the region. It was developed in collaboration with the members of the ASEAN-OECD Good Regulatory Practices Network, and key regional partners including the ASEAN Secretariat and the Economic Research Institute for ASEAN and East Asia (ERIA).

Abstract

The Oxford Handbook of Administrative Justice examines the wide range of scholarship exploring the administrative decisions made by public authorities that affect individual citizens and the mechanisms available for the provision of redress. The Handbook identifies and provides a survey of key transnational themes in administrative justice research, considers theoretical and methodological approaches to administrative justice, and provides a view ofthe future of administrative justice research.One aspect of administrative justice, namely the study of law and administration, is a core component of law school syllabuses and scholarly research around the world. For many public lawyers, this area of study has been focused heavily on legalistic redress systems (e.g. judicial review). Justice against administrations, however, is delivered through a much broader range of mechanisms than legalistic processes alone: fair initial decision-making procedures, internal review systems, ombuds,administrative tribunals/adjudication, and other institutions play a vital role.Despite their importance to modern governance across the globe (and to the lives of individual citizens), these broader aspects of administrative justice have been left relatively neglected and under-researched, and the Handbook represents a groundbreaking achievement in establishing administrative justice research as a vital and discrete area of study. Ondertussen heeft zich omtrent de administratieve cassatie een omvangrijke rechtspraak van de Raad van State ontwikkeld en hebben ook verschillende auteurs talloze bijdragen tot stand gebracht voor wat betreft de verschillende aspecten van het administratief cassatieberoep. Deze publicatie belicht de verschillende aspecten van het administratief cassatieberoep en gidst langsheen de verschillende valkuilen die op het pad van een administratief cassatieberoep liggen. Zo wordt onder meer stilgestaan bij de verschillende procedureregels, de zogenaamde “filterprocedure” en het cassatiemiddel. Abstract

Over the last decade, the Supreme Court of Pakistan has emerged as a powerful and overtly political institution. While the strong form of judicial review adopted by the Supreme Court has fostered the perception of a sudden and ahistorical judicialisation of politics, the judiciary's prominent role in adjudicating issues of governance and statecraft was long in the making. This book presents a deeply contextualised account of law in Pakistan and situates the judicial review jurisprudence of the superior courts in the context of historical developments in constitutional politics, evolution of state structures and broader social transformations. This book highlights that the bedrock of judicial review has remained in administrative law; it is through the consistent development of the 'Writ jurisdiction' and the judicial review of administrative action that Pakistan's superior courts have progressively carved an expansive institutional role and aggrandised themselves to the status of the regulator of the state.

La pandémie de Covid-19 démontre l'ambivalence juridique de l'aléa : alors même que l'aléa déjoue la prévisibilité et la régularité attachées à la sécurité juridique, le droit apprivoise l'aléa et cherche à s'adapter à ses conséquences. A travers la jurisprudence sur le risque des pesticides ou des OGM, sur la théorie de l'imprévision ou du fait du prince, sur les armes de la police ou l'aléa thérapeutique, nous verrons que le juge administratif cherche à consolider l'ordre juridique et, partant, l'ordre politique et social. - Ainsi, l'aléa offre l'opportunité de comprendre les facteurs sociologiques et institutionnels qui expliquent la jurisprudence élaborée par le juge administratif.
