Abstract

Presents a new way of thinking about the relationship between law and language Invites the reader to rethink the value of legal rhetorics, understood as a broad field including argumentation, epistemology, and legal practice and experienceIntroduces casuistry as a new perspective valuable also for civil law systemsIllustrates how single cases interpellate general norms and thus invites a reflection on legal normativityAre the general and the particular separated in legal rhetorics? What is the function of singular events, facts, names in legal argumentation and what is their relationship to legal normativity? Bringing together an international range of legal scholars, this collection takes a diachronic approach and addresses these questions from the perspective of contemporary legal discourse.The book explores the changes in legal form and transmission that have been generated both by globalisation and by common law’s irreversible encounter with the civilian methods of European law. It explores how, in the contemporary legal discourse, exemplarity – and all rhetoric processes based on the general-particular dichotomy more generally – regained relevance. In doing so, it highlights the centrality of the example and proposes the development of new rhetorical approaches better suited to today’s legal practices which operate in a globalised field.

Abstract

This Element explores relationships between collocations, writing quality, and learner and contextual variables in a first-year composition (FYC) programme. Comprising three studies, the Element is anchored in understanding phraseological complexity and its sub-constructs of sophistication and diversity. First, the authors look at sophistication through association measures. They tap into how these measures may tell us different types of information about collocation via a cluster analysis. Selected measures from this clustering are used in a cumulative links model to establish relationships between these measures, measures of diversity and measures of task, the language background of the writer and individual writer variation, and writing quality scores. A third qualitative study of the statistically significant predictors helps understand how writers use collocations and why they might be favoured or downgraded by raters. This Element concludes by considering the implications of this modelling for assessment.

Abstract

Studies of Sr isotopic composition of thousands of samples of marine sediments and fossils have yielded a curve of 87Sr/86Sr versus age for seawater Sr that extends back to 1 billion years. The ratio has fluctuated with large amplitude during this time period, and because the ratio is always uniform in the oceans globally at any one time, it is useful as a stratigraphic correlation and age-dating tool. The ratio also appears to reflect major tectonic and climatic events in Earth history and hence provides clues as to the causes, timing, and consequences of those events. The seawater 87Sr/86Sr ratio is generally high during periods marked by continent-continent collisions, and lower when continental topography is subdued, and seafloor generation rates are high. There is evidence that major shifts in the seawater ratio can be ascribed to specific orogenic events and correlate with large shifts in global climate.

Abstract

Ancient glass beads as a window to the ancient world Glass beads, both beautiful and portable, have been produced and traded globally for thousands of years. Modern archaeologists study these artifacts through sophisticated methods that analyze the glass composition, a process which can be utilized to trace bead usage through time and across regions. This book publishes open-access compositional data obtained from laser ablation - inductively coupled plasma - mass spectrometry, from a single analytical laboratory, providing a uniquely comparative data set. The geographic range includes studies of beads produced in Europe and traded widely across North America and beads from South and Southeast Asia traded around the Indian Ocean and beyond. The contributors provide new insight on the timing of interregional interactions, technologies of bead production and patterns of trade and exchange, using glass beads as a window to the past. This volume will be a key reference for glass researchers, archaeologists, and any scholars interested in material culture and exchange; it provides a wide range of case studies in the investigation and interpretation of glass bead composition, production and exchange since ancient times.
