Der Europäische Verband der Richter in Handelssachen (www.uemc.eu) hat das seit 2009 laufende Projekt «Best Practice» weiter gefördert und kommt mit dem vorliegenden Rechtsvergleich zu folgendem Fazit: - Weiterführung in jenen europäischen Staaten, die eine spezialisierte Handelsgerichtsbarkeit kennen (Schweiz, Österreich, Deutschland, Frankreich und Belgien) - Mitwirkung der Handelsrichter als Spezialisten (Fachrichter nach Schweizer Innovation) oder als Generalisten mit besonderen Kenntnissen des Wirtschaftslebens mit einer Tendenz zur Flexibilisierung des Beizugs der Handelsrichter nach ihrem Fachwissen - Einrichtung von nationalen Experten-Pools der Handelsrichter, die als Spezialisten regional in anderen Handelsgerichten eingesetzt werden können - Einrichtung von Abteilungen in bestehenden Handelsgerichten für internationale Streitbeilegung zwischen Unternehmen mit Verfahrenssprache Englisch - Innovative Option für alle Unternehmen, neben der privatisierten Justiz der Schiedsgerichte, ein staatliches Handelsgericht als Schiedsgericht wählen zu können Die Postulate dieses Fazits sind das Ergebnis der Länderberichte zu den Zielvorgaben einer sachgerechten, raschen und damit kostengünstigen Ziviljustiz, die damit die Zukunft der Europäischen Handelsgerichtsbarkeit im Interesse der Unternehmen gewährleistet.
