Both communitarianism and casuistry have sought to restore ethics as a practical science -- the former by incorporating various traditions into a shared definition of the common good, the latter by considering the circumstances of each situation through critical reasoning. Mark G. Kuczewski analyzes the origins and methods of these two approaches and forges from them a new unified approach. This approach takes the communitarian notion of the person as its starting point but also relies upon the narrative and analogical tools of case-based reasoning. He separates out the rhetoric that is incongruent with the Aristotelian aspirations of each method to show that the two are complementary, and that consensus can emerge from fragmentation. He then applies his resulting method to three major problems in bioethics: the difficulties that the issue of personal identity poses for advance directives, the role of the family in medical decision making, and the refusal of treatment because of religious beliefs. He analyzes the need to assume a communitarian notion of the person as a starting point for the application of casuist insights. Combining theoretical, practical, and scholarly insights, this book will be of interest to philosophers, political and social scientists and bioethicists.

This collection of thirty-one cases and commentaries addresses ethical problems commonly encountered by the average health care professional, not just those working on such high-tech specialties as organ transplants or genetic engineering. It deals with familiar issues that are rarely considered in ethics casebooks, including such fundamental matters as informed consent, patient decision-making capacity, the role of the family, and end-of-life decisions. It also provides resources for basic but neglected ethical issues involving placement decisions for elderly or technologically dependent patients, rehabilitation care, confidentiality regarding AIDS, professional responsibility, and organizational and institutional ethics. The authors describe in detail the perspectives of each party to the case, the kind of language that ethicists use to discuss the issues, and the outcome of the case. A short bibliography suggests useful articles for further reading or curriculum development. Easily understood by readers with no prior training in ethics, this book offers guidance on everyday problems from across the broad continuum of care. It will be valuable for health-care professionals, hospital ethics committees, and for students preparing for careers in health-care professions.

Bedau demonstrates the usefulness of "casuistry", or "the method of cases" in arriving at moral decisions. He examines cases that may compel us to consider questions about who ought to survive when not all can. It seeks to teach something about how we actually reason concerning such life and death situations, as well as about how we ought to reason if we wish both to be consistent and properly respect human life. This book is intended for students and scholars of philosophical ethics. Bedau demonstrates the usefulness of "casuistry", or "the method of cases" in arriving at moral decisions. Medical ethics is a topic of increased importance in the new undergraduate curriculum and this textbook will provide the only resource published in the UK which is aimed specifically at medical students, rather than experienced practitioners. Realistic case studies introduce the discussion in each chapter - highly suitable for case based courses - while there is practical coverage of all the issues likely to be of concern to students during their medical careers. This includes informed consent and refusal of treatment, confidentiality, euthanasia, advanced directives, negligence and malpractice, the new genetics, abortion and the rationing of health care.

An overview of the key debates in biomedical research ethics, presented through a wide-ranging selection of 149 case studies. This textbook for instruction in biomedical research ethics can also serve as a valuable reference for professionals in the field of bioethics. The 149 cases included in the book are grouped in nine chapters, each of which covers a key area of debate in the field. Some of the case studies are classics, including the famous cases of the Tuskegee Syphilis Study (in which subjects with syphilis were not given treatment) and the Willowbrook hepatitis studies (in which institutionalized subjects were intentionally exposed to hepatitis). Others focus on such current issues as human embryonic stem cell research, cloning by somatic nuclear transfer, and the design and function of institutional review boards. Each chapter begins with a brief introduction that places the issues raised in context; this is followed by a number of cases (each of which is no more than a few pages). Study questions meant to encourage further discussion follow each case. After an introductory discussion of the history and tenets of ethics in medical research, the book's chapters cover the topics of oversight and study design; informed consent; the selection of subjects; conflicts of interest; the social effects of research; embryos, fetuses, and children; genetic research; the use of animals; and authorship and publication. Following these chapters are appendixes with the texts of the Nuremburg Code and the Declaration of Helsinki, two key documents in the establishment of bioethical standards for research.

Did the Gulf War defend moral principle or Western oil interests? Is violent pornography an act of free speech or an act of violence against women? In this text Richard B. Miller attempts to shed new light on the potential of casuistry case-based reasoning for resolving these and other questions of conscience raised by the practical quandaries of modern life. Rejecting the packaging of moral experience within simple descriptions and inflexible principles, Miller argues instead for identifying and making sense of the ethically salient features of individual cases. Because this practical approach must cope with a diverse array of experiences, Miller draws on a wide variety of diag nostic tools from such fields as philosophy of science, legal reasoning, and theology.
