Abstract

Both communitarianism and casuistry have sought to restore ethics as a practical science -- the former by incorporating various traditions into a shared definition of the common good, the latter by considering the circumstances of each situation through critical reasoning. Mark G. Kuczewski analyzes the origins and methods of these two approaches and forges from them a new unified approach. This approach takes the communitarian notion of the person as its starting point but also relies upon the narrative and analogical tools of case-based reasoning. He separates out the rhetoric that is incongruent with the Aristotelian aspirations of each method to show that the two are complementary, and that consensus can emerge from fragmentation. He then applies his resulting method to three major problems in bioethics: the difficulties that the issue of personal identity poses for advance directives, the role of the family in medical decision making, and the refusal of treatment because of religious beliefs. He analyzes the need to assume a communitarian notion of the person as a starting point for the application of casuist insights. Combining theoretical, practical, and scholarly insights, this book will be of interest to philosophers, political and social scientists and bioethicists.

An overview of the key debates in biomedical research ethics, presented through a wide-ranging selection of 149 case studies. This textbook for instruction in biomedical research ethics can also serve as a valuable reference for professionals in the field of bioethics. The 149 cases included in the book are grouped in nine chapters, each of which covers a key area of debate in the field. Some of the case studies are classics, including the famous cases of the Tuskegee Syphilis Study (in which subjects with syphilis were not given treatment) and the Willowbrook hepatitis studies (in which institutionalized subjects were intentionally exposed to hepatitis). Others focus on such current issues as human embryonic stem cell research, cloning by somatic nuclear transfer, and the design and function of institutional review boards. Each chapter begins with a brief introduction that places the issues raised in context; this is followed by a number of cases (each of which is no more than a few pages). Study questions meant to encourage further discussion follow each case. After an introductory discussion of the history and tenets of ethics in medical research, the book's chapters cover the topics of oversight and study design; informed consent; the selection of subjects; conflicts of interest; the social effects of research; embryos, fetuses, and children; genetic research; the use of animals; and authorship and publication. Les politiques en santé et sécurité n'abordent généralement pas la dimension de genre: les risques spécifiques aux femmes sont soit ignorés soit sous-estimés; les priorités sont définies pour des activités et des secteurs spécifiquement masculins, etc. Le fait de ne pas prendre en compte la question de la santé des femmes au travail constitue une barrière à la mise en place de politiques efficaces de santé au travail et d'égalité des chances. Depuis plusieurs années, le département santé et sécurité de l’ETUI et la CES s'efforcent d'intégrer la dimension de genre dans leur politique de santé au travail. En 2001, ils ont décidé de mener une enquête dans les quinze pays de l'UE afin d'évaluer la situation dans deux domaines: •l'intégration de la dimension de genre dans les politiques de santé et de sécurité. L'objectif consistait à vérifier l'importance accordée aux questions relatives à la santé des femmes lors de la définition des priorités, des activités de recherche et des données statistiques, ainsi que l'importance que leur accordent les institutions et les acteurs respectifs; •l'identification d'expériences pratiques d'intervention en santé et sécurité qui tiennent compte de la dimension de genre. Cette publication présente à la fois un exposé synthétique des principaux thèmes abordés par la recherche (l'état des connaissances, l'état des politiques et les perspectives) ainsi que des études de cas dans différents pays de l'Union européenne.
