Sociaal werkers hebben tijdens het werk de ruimte om af te stemmen op de mensen met wie ze werken om ze zo tot hun recht te laten komen. Ze hebben echter ook te maken met kaders zoals wetgeving, beleid en professionele standaarden voor het beoordelen, beslissen en handelen. Cette recherche interdisciplinaire, issue d'une thèse de doctorat, amorce une nouvelle réflexion théorique à propos de la fonction du contrat. Le cadre théorique honnethien de la reconnaissance est mobilisé afin de repenser l'outillage conceptuel classique de la théorie du contrat juridique, soit l'autonomie de la volonté et la liberté contractuelle. En abordant les relations contractuelles sous l'angle de la reconnaissance et de l'intersubjectivité, il apparaît que le droit positif n'a pas nécessairement pour effet d'anéantir ou contredire ces principes ; se situant sur un tout autre plan, bon nombre de dispositions ont le potentiel d'agir à titre de garanties minimales de l'autonomie individuelle et de la liberté sociale des parties dans leurs relations contractuelles concrètes. Le contrat, par le droit positif qui régit les relations entre ses parties, et au-delà de sa fonction symbolique, peut revêtir une fonction institutionnelle où s'entrecroisent des considérations économiques, politiques et sociales. La critique des techniques juridiques utilisées et de l'amplitude de l'institutionnalisation de la relation contractuelle laisse cependant entrevoir les limites de la fonction du contrat.

Instead, the concept of a philosophical religion was strongly influential on pagan, Jewish, Christian and Muslim philosophers alike. Carlos Fraenkel provides the first account of this concept and traces its history back to Plato, the Jewish Philo of Alexandria and the Christians Clement of Alexandria and Origen.
