De bijdragen zijn zowel persoonlijk als wetenschappelijk van aard en situeren zich in de notariële sfeer en de bijzondere kennis- en expertisedomeinen van de gevierde. André Michielsens heeft naast zijn opdracht als notaris en professor ook talrijke leidende functies in diverse notariële instellingen op nationaal én op internationaal vlak vervuld. Dit Liber Amicorum vormt, door de selectie van auteurs en thema’s, een afspiegeling van de rijkgevulde loopbaan van de gevierde, die niet enkel op pedagogisch en academisch, maar ook op maatschappelijk vlak veel betekend heeft voor de notariële wereld.

Since 2015... Le présent ouvrage rassemble les contributions présentées au colloque « Tapas » organisé le 12 décembre 2017, pour la troisième année consécutive, par le Master de spécialisation en notariat de l'UCL. Un thème est au menu de cette édition : les donations. Elles sont abordées sous toutes leurs coutures, depuis la question de leur preuve dans les relations entre époux jusqu'aux formalités administratives qu'elles impliquent en matière immobilière, sans oublier le droit civil, le droit fiscal, le droit des sociétés, le droit international privé et celui de la pratique notariale. Surtout, les donations sont au cœur de la réforme du droit successoral intervenue le 31 juillet 2017. Elles y suscitent d'intéressantes questions de droit transitoire dont le législateur a laissé aux notaires le soin de démêler l'écheveau. Les Tapas s'y arrêtent et les auteurs s'essayent à une première étude d'ensemble du régime transitoire de la réforme des successions. Les Tapas sont le fruit d'un travail en équipe, l'occasion d'un échange et d'un approfondissement de la réflexion.

Alleen verdichting en stapeling zal nog tegemoet kunnen komen aan de oplopende behoefte aan een leef- en werkbare huisvesting van personen en bedrijven. In het ‘Handboek voor uitgifte van zakelijke rechten voor de notariële praktijk’ brengt Roland Timmermans alle rechtsfiguren samen die het meest geschikt zijn om aan de nieuwe trend van verdichting en stapeling van bouwwerken gestalte te geven, zoals bv.: erfdienstbaarheden, gedwongen mede-eigendom ten titel van bijzaak,appartementseigendom, erfpacht, horizontaal verdeelde erfpacht, opstal, verdiepingseigendom, volume-eigendom, dubbel grondgebruik en stapeling van beperkte rechten. Per afzonderlijk zakelijk recht worden alle relevante wettelijke voorschriften en praktijkontwikkelingen opgegeven en ontleed, en aangevuld met een ruime keuze tussen tientallen modelakten die naargelang het geval kunnen worden gebruikt. De auteur besteedt aandacht aan bouwwerken met een specifiek bouwkundig patroon, zoals geclusterde bouw, parkmanagement, weekendverblijfpark en stadsontwikkelingsgebied, of aan bouwwerken met een bepaald thema, zoals een gebouw met parkeervoorzieningen, een kantoorflatgebouw, een serviceflatgebouw, een assistentiewoonflatgebouw, een winkelcomplex, een loftcomplex, een kasteel, een timesharingcomplex, een hotelflatgebouw, een woonerf, een kmo-complex tot en met drijvende opstallen. In een omgeving waar de vrijheid om te bouwen kleiner en kleiner wordt, bevat dit naslagwerk niet alleen de nodige stof tot overdenking over verdichting en stapeling, maar leert het tevens hoe de diverse zakelijke rechten door aangepaste montages inzetbaar zijn bij de uitgiftepraktijk van modernistische en futuristische bouwprojecten
