Like the ancient ouroboros devouring its own tail, we are products of our own education, our own rules and methods of cognizing and shaping the world. As such, we are also their victims, living mostly by habit and inherited rules of conduct questioning them only in the moments of crises and sometimes even not then. The purpose of this book is to explore the nature of autopoiesis or the ability of society and its various forms to create, re-create and maintain itself, by putting it in the broader interdisciplinary perspective as having been established within the project itself. The mark of the book is its broad interdisciplinary quality, stretching from philosophy, religious studies and literary theory to new media, linguistics, and political theory.

The thesis examines the dialectic between fact and law in the juridical experience of Rome in the light of the principle of appearance of law. For each of the main manifestations of the principle of appearance (apparent heir, apparent creditor, apparent representative) a possible historical antecedent in Roman law (possessor pro herede, falsus creditor, falsus procurator) is identified, a detailed analysis of which is proposed, taking into account ancient sources and doctrinal interpretations. Subsequently the 'de facto' family relationships (more uxorio relations, matrimonium iniustum and concubinage) are examined, since they can in turn be traced back to the principle of appearance. In its questioning of the reasons of the extension of the juridical discipline to the apparent case, the research identifies a common tendency to the various phenomena that, although heterogeneous, express the same tension between fact and law present in the legal systems of every historical epoch.

Das Buch zeigt romischrechtliche Entwicklungslinien zum Rechtsinstitut der "Schenkung unter Auflage" auf, woraus sich Folgerungen fur das bereicherungsrechtliche Denken ergeben, insbesondere in Form der condictio ob rem mit Ausblick auf ein allgemeines Verstandnis der dationes ob rem.Die Autorin untersucht die romischrechtlichen Aspekte einer Schenkung, die sich dadurch auszeichnet, dass der Schenker dem Beschenkten auch ein bestimmtes Tun oder Unterlassen auferlegt. Dadurch, dass der Erwerb der liberalitas mit einer Verpflichtung des Beschenkten verbunden ist, entsteht eine Reihe von Fragen, die im modernen Zivilrecht nicht an Aktualitat verloren haben: Ist die mit einer Verpflichtung des Beschenkten behaftete Zuwendung immer noch eine Schenkung oder bereits ein gemischtes, gar entgeltliches Geschaft? Welcher Anspruch steht dem Schenker, beziehungsweise dem auflagenberechtigten Dritten bei Nichterfullung der Auflage zu? Worin liegt der Unterschied zwischen einer Schenkung unter Auflage und einem negotium mixtum cum donatione? Und nicht zuletzt, wie konstituiert das Verhaltnis zwischen der Nichterfullung der Auflage und dem Undank des Beschenkten?

Recent archaeological work has shown that maritime trade across the Mediterranean intensified greatly at the same time as the Roman state was extending its power overseas. This book explores aspects of this development and its relationship with changes in the legal and institutional apparatus that supported maritime commerce. It analyses the socio-legal framework within which maritime trade was conducted, and in doing so presents a new understanding of the role played by legal and social institutions in the economy of the Roman world.

Que Montesquieu ait le genre d'esprit de Montaigne, comme on a pu le dire à propos de l'auteur de "L'esprit des lois", signifie en premier lieu que l'histoire de tous les hommes qui ont vécu s'offre d'abord pour lui comme une sorte de présent universel. L'écoulement temporel n'implique pas que l'histoire du monde soit partagée en époques. Et les faits historiques se disposent dans un milieu temporel homogène. Ainsi Montesquieu rompt-il radicalement avec la conception chrétienne de l'histoire qui suppose, quant à elle, des époques et donc une altération radicale de notre rapport au temps historique à partir de la venue du Christ. Mais Montesquieu pense évidemment le rapport de l'avant et de l'après, la différence de l'Ancien et du Moderne. L'enjeu est alors de comprendre comment cette différence peut être prise en compte sans faire intervenir un partage des époques de l'histoire universelle. Montesquieu est un jurisconsulte et un historien du droit. Et c'est dans la connaissance du droit français et du droit romain, de leur filiation, qu'il trouve les concepts qui président à l'interprétation de l'histoire. Il y découvre en particulier un modèle de production du droit qui est celui de l'équité romaine et du droit prétorien ainsi qu'une certaine idée de la nouveauté qui se manifeste comme retour d'un passé occulté et non sous la forme d'un commencement absolu. Sous cette double hypothèse, les concepts de la philosophie politique et les faits de l'histoire universelle s'ordonnent dans "L'esprit des lois" en vue de la constitution d'une "summa ratio" qui n'est pas celle d'un législateur, mais plutôt de l'esprit législateur à l'oeuvre dans l'histoire.

Die Stipulation ist eine der bemerkenswertesten Vertragstypen des römischen Rechts. Sie kam zustande, indem der Gläubiger eine Frage formulierte und der Schuldner diese Frage durch die Wiederholung des Verbs bejahte, welches der Gläubiger verwendet hatte. Inhaltlich war eine Stipulation meistens auf die Zahlung von Geld gerichtet. Manchmal verpflichtete sich der Schuldner auch zu anderen Handlungen. In die Stipulationsfrage konnte der Stipulator eine dritte Person hinzufügen, indem er nach der Nennung seiner eigenen Person, die regelmäßig mit dem Personalpronomen mihi geschah, die Konjunktion aut und dahinter den Dritten im Dativ anfügte. Diese dritte Person wird in der Literatur gewöhnlich in Anlehnung an den spätklassischen Juristen Marcian als solutionis causa adiectus oder adiectus solutionis causa bezeichnet. Der solutionis causa adiectus erwarb kein eigenes Recht auf den geschuldeten Gegenstand der Stipulation. An ihn konnte lediglich mit befreiender Wirkung geleistet werden. Gleichzeitig konnte der Gläubiger dem Schuldner ohne dessen Zustimmung die Befugnis nicht mehr entziehen, an den adiectus wirksam zu leisten, sobald die adiectio wirksam vereinbart war. Der Autor untersucht alle überlieferten Quellenstellen, die einen Bezug zu dem solutionis causa adiectus haben und zeichnet damit erstmals ein umfassendes Bild dieser Rechtsfigur.
