Abstract

Dieser Band präsentiert zunächst die Morphologie der 432 Titel der Pandekten als weitgehend rhetorisch komponiert, woraufhin diese Einsicht in eine systematische Hermeneutik übersetzt wird: die Titel der Pandekten sind – auch – systematisch auszulegen. Friedrich Bluhmes Massentheorie erscheint daher richtig, aber unvollständig und beweist nicht, dass das räumliche Nacheinander der die Titel ausmachenden Leges die unabsichtliche Folge des zeitlichen Nacheinanders des Exzerpierens ist. Es scheint vielmehr die absichtliche Folge eines Kompositionsbestrebens zu sein. Bei einer konsequenten Anwendung von Bluhmes eigener Methode käme man zu dem Ergebnis, dass etwa ein Viertel der Leges nicht dort alloziert sind, wo sie theoretisch stehen müssten. Durch diese ‚Versetzungen‘ werden semantische Systeme mit den umgebenden Stellen etabliert, indem die Kompilatoren mittels der Leittextmethode in einen textlichen Hauptstrang Nebenstränge einflechten.

Abstract

La théorie du patrimoine d’Aubry et Rau est depuis quelques années contournée par la pratique et parfois le législateur afin de créer en droit français des patrimoines d’affectation. Répondant à un évident besoin de la pratique, l’affectation patrimoniale présente de multiples intérêts, que les réformes récentes, de la fiducie ou de l’EIRL, mettent de plus en plus en lumière. Elles offrent l’occasion de réfléchir à cette notion de patrimoine affecté, son ou ses usages, tant en droit français qu’à la lumière de droits étrangers, comme les droits anglo-saxons, québécois ou encore chinois.

Abstract

This short monograph attempts an exploration of the legal treatment of evidence questions in Cyprus law. The first section of the study offers a comparative-law introduction to the legal system of Cyprus – a mixed legal system that in matters of civil litigation, including evidence, tends to strongly follow the English common law tradition (including the existence of an autonomous legal field of evidence law, that tends to be dominated by criminal evidence law. The second section presents the general principles underlying Cypriot civil procedure, including evidence. The sections that follow examine in more detail legal aspects involving civil evidence, especially how the basic types of evidence are treated in Cyprus law and how the processes for the taking of evidence are organized. The study also examines special questions including the legal treatment of illegally obtained evidence, legal costs and problems of language. The final section examines the cross-border dimensions of civil evidence-taking.

Abstract

Ireland as a common law jurisdiction operates an adversarial system. Ireland has a written Constitution, Bunreacht na h-Éireann. Other sources of law include legislation and European Union Law and a doctrine of precedent operates. This paper comprises a discussion of the law of evidence in Irish Civil Procedure. It follows the structure of a questionnaire circulated for the purposes of a comparative study as part of an EU wide project and is repetitive in parts. It was completed between November 2013 and August 2014 and in the interim there have been significant developments in the Irish legal system, most notably the establishment of the Court of Appeal and the Supreme Court decision in D.P.P. v. J.C. [2015] IESC 31, which modified the exclusionary rule concerning unconstitutionally obtained evidence. The primary form of proof in Irish courts is oral evidence. Competent witnesses are generally compellable. Usually testimony, on oath or affirmation, is given viva voce in open court before the Judge and where necessary a jury, and in the presence of the parties. The right to cross-examine is constitutionally guaranteed. In civil cases, the standard of proof is the balance of probabilities. The burden of proof rests on the party which asserts. The principle of audi alteram partem applies. A distinction is drawn between unconstitutionally obtained evidence and illegally obtained evidence. There is pre-trial discovery. Evidence taking by and for foreign courts is discussed.

These documents, previously unedited, shed new light on the history of customary law ('urf) in Yemen. Abstract

This collection deals with an ancient institution in Eastern Polynesia called the rahui, a form of restricting access to resources and/or territories. While tapu had been extensively discussed in the scientific literature on Oceanian anthropology, the rahui is quite absent from secondary modern literature. This situation is all the more problematic because individual actors, societies, and states in the Pacific are readapting such concepts to their current needs, such as environment regulation or cultural legitimacy. This book assembles a comprehensive collection of current works on the rahui from a legal pluralism perspective. This study as a whole underlines the new assertion of identity that has flowed from the cultural dimension of the rahui. Today, rahui have become a means for indigenous communities to be fully recognised on a political level. Some indigenous communities choose to restore the rahui in order to preserve political control of their territory or, in some cases, to get it back. For the state, better control of the rahui represents a way of asserting its legitimacy and its sovereignty, in the face of this reassertion by indigenous communities.

Abstract

Common Law, Civil Law, and Colonial Law builds upon the legal historian F.W. Maitland's famous observation that history involves comparison, and that those who ignore every system but their own 'hardly came in sight of the idea of legal history'. The extensive introduction addresses the intellectual challenges posed by comparative approaches to legal history. This is followed by twelve essays derived from papers delivered at the 24th British Legal History Conference. These essays explore patterns in legal norms, processes, and practice across an exceptionally broad chronological and geographical range. Carefully selected to provide a network of inter-connections, they contribute to our better understanding of legal history by combining depth of analysis with historical contextualization.
