Abstract

This edited volume examines the performance and role of scientific experts in modern European courts of law and police investigations. It discusses cases from criminal, civil and international law to parse the impact of forensic evidence and expertise in different European countries. The contributors show how modern forensic science and technology are inextricably entangled with political ideology, gender norms and changes in the law and legal systems. Discussing fascinating case studies, they highlight how the ideology of authoritarian and liberal regimes has affected the practical enactment of forensic expertise. They also emphasise the influence of images of masculinity and femininity on the performance of experts and on their assessment of evidence, victims and perpetrators. This book is an important contribution to our knowledge of modern European forensic practices.

Abstract

Originally published in 1968. Far from being an isolated outburst of community insanity or hysteria, the Massachusetts witchcraft trials were an accurate reflection of the scientific ethos of the seventeenth century. Witches were seldom hanged without supporting medical evidence. Professor Fox clarifies this use of scientific knowledge by examining the Scientific Revolution's impact on the witchcraft trials. He suggests that much of the scientific ineptitude and lack of sophistication that characterized the witchcraft cases is still present in our modern system of justice. In the historical context of seventeenth-century witch hunts and in an effort to stimulate those who must design and operate a just jurisprudence today, Fox asks what the proper legal role of medical science—especially psychiatry—should be in any society. The legal system of seventeenth-century Massachusetts was weakened by an uncritical reliance on scientific judgments, and the scientific assumptions upon which the colonial conception of witchcraft was based reinforced these doubtful judgments. Fox explores these assumptions, discusses the actual participation of scientists in the investigations, and indicates the importance of scientific attitudes in the trials. Disease theory, psychopathology, and autopsy procedures, he finds, all had their place in the identification of witches. The book presents a unique multidisciplinary investigation into the place of science in the life of the Massachusetts Bay Colony in the seventeenth century. There, as in twentieth-century America, citizens were confronted with the necessity of accommodating both the rules of law and the facts of science to their system of justice.

Abstract

La médecine légale s’ancre depuis longtemps dans les savoirs naturalistes et normatifs qui mettent en signes et sens judiciaires le corps meurtri. Connus des Romains selon le Digeste, en place dans les coutumiers médiévaux, imposés par la législation des États absolutistes dans les cas de grossesse illégitime, d’infanticide, d’empoisonnement et de blessures mortelles ou non, devenus routiniers et réglés par des Édits multipliés au temps des Lumières dans le cadre de la justice pénale, les savoirs médico-légaux s’imposent comme la médecine du crime. La médecine légale, qui s’est construite comme une science depuis le XIXe siècle entre la scène du crime, l’université, la morgue, le laboratoire et les cours de justice, a une histoire qui remonte à la Renaissance au moins. En atteste cet ouvrage constitué d’archives. Il donne à lire un corpus inédit d’environ 400 expertises médico-légales que signent au XVIIIe siècle à Genève des chirurgiens et des médecins assermentés en justice. Autour des enjeux judiciaires de l’expertise médico-légale qui limite l’arbitraire du juge, cette documentation permet d’historiciser la fabrique institutionnelle et sociale du savoir médico-légal sur le terrain du crime. L’investigation judiciaire et les expertises médico-légales qualifient et mesurent les conséquences morbides du passage à l’acte suicidaire ou criminel. Par l’objectivation naturaliste des plaies et des traumatismes, les experts mettent en indices judiciaires les corps meurtris.

Abstract

Die Studie behandelt das in der sozialrechtlichen Praxis sehr umstrittene Antragsrecht auf Anhörung eines bestimmten Arztes im sozialgerichtlichen Verfahren (§ 109 SGG). In Prozessen vor den Sozialgerichten wird häufig um komplexe medizinische Fragen gestritten. Daher wird im Rahmen der gerichtlichen Sachverhaltsaufklärung häufig ärztlicher Sachverstand beigezogen. Das Sozialgerichtsgesetz kennt neben der Gutachteneinholung von Amts wegen die Besonderheit der Anhörung eines von der Klagepartei benannten Arztes. Die Arbeit ordnet das Antragsrecht zunächst dogmatisch ein und untersucht insbesondere, welche Zwecke dieses verfolgt, und wie es sich zur gerichtlichen Sachverhaltsaufklärung verhält. Im zweiten, dem empirischen Teil wird auf Basis einer bundesweiten Untersuchung sozialgerichtlicher Verfahren der Frage nachgegangen, ob und in welcher Weise sich die von der Klagepartei veranlassten Gutachten auf den Prozessverlauf und das Prozessergebnis auswirken. Damit ist die Arbeit zugleich ein Beitrag zur Verbindung von Rechtsdogmatik und Rechtstatsachenforschung.

Bayes Factors for Forensic Decision Analyses with R provides a self-contained introduction to computational Bayesian statistics using R. With its primary focus on Bayes factors supported by data sets, this book features an operational perspective, practical relevance, and applicability—keeping theoretical and philosophical justifications limited. It offers a balanced approach to three naturally interrelated topics: Probabilistic Inference - Relies on the core concept of Bayesian inferential statistics, to help practicing forensic scientists in the logical and balanced evaluation of the weight of evidence. Decision Making - Features how Bayes factors are interpreted in practical applications to help address questions of decision analysis involving the use of forensic science in the law. Operational Relevance - Combines inference and decision, backed up with practical examples and complete sample code in R, including sensitivity analyses and discussion on how to interpret results in context. Over the past decades, probabilistic methods have established a firm position as a reference approach for the management of uncertainty in virtually all areas of science, including forensic science, with Bayes' theorem providing the fundamental logical tenet for assessing how new information—scientific evidence—ought to be weighed. Central to this approach is the Bayes factor, which clarifies the evidential meaning of new information, by providing a measure of the change in the odds in favor of a proposition of interest, when going from the prior to the posterior distribution. Bayes factors should guide the scientist's thinking about the value of scientific evidence and form the basis of logical and balanced reporting practices, thus representing essential foundations for rational decision making under uncertainty. This book would be relevant to students, practitioners, and applied statisticians interested in inference and decision analyses in the critical field of forensic science. It could be used to support practical courses on Bayesian statistics and decision theory at both undergraduate and graduate levels, and will be of equal interest to forensic scientists and practitioners of Bayesian statistics for driving their evaluations and the use of R for their purposes. Abstract

The natriuretic peptides (NPs) family includes a class of hormones and their receptors needed for the physiological control of cardiovascular functions. The discovery of NPs provided a fundamental contribution into our understanding of the physiological regulation of blood pressure, and of heart and kidney functions. NPs have also been implicated in the pathogenesis of several cardiovascular diseases (CVDs), including hypertension, atherosclerosis, heart failure, and stroke. A fine comprehension of the molecular mechanisms dependent from NPs and underlying the promotion of cardiovascular damage has contributed to improve our understanding of the molecular basis of all major CVDs. Finally, the opportunity to target NPs in order to develop new therapeutic tools for a better treatment of CVDs has been developed over the years. The current Special Issue of the Journal covers all major aspects of the molecular implications of NPs in physiology and pathology of the cardiovascular system, including NP-based therapeutic approaches.

Abstract

When the domestic government, the private sector, and people in various professional fields talk about long-term care issues, they all focus on creating a warm and home-like care institution. However, we actively emphasize the importance of community-based long-term care. For “aging in place”, the development of domestic non-institutional care is still in its infancy, and some long-term care needs must still be met through institutional care, and the facilitation of the extension or outreach of community-based care and respite service platforms for the development of community-based long-term care still rely on institutional care. The history of the development of long-term care in Taiwan is much shorter than that of Japan, Europe, the United States, and Canada. Despite years of hard work and rapid development, the long-term care resources needed to establish a complete system in terms of universalization, fairness, accessibility, and selectivity are not available. In the future, based on the soundness of institutional care, it hoped that outreach will move toward the goals of community care and aging in place. We hope the studies in this Special Issue will help further develop clinical medicine for healthcare and stainability.
