In der Gruppe der Hamburger Mäzene, die 1907 mit ihren Spenden die Hamburgische Wissenschaftliche Stiftung ins Leben riefen und damit zwölf Jahre später die Gründung der Hamburger Universität ermöglichten, ist der Kaufmann Georg Hermann Stoltz (1845-1939) mit seiner Biografie in vieler Hinsicht ein typischer Vertreter. Wie manche andere der Gruppe baute er einen weitgespannten Handel zwischen Südamerika, im Besonderen zwischen Brasilien und Hamburg auf. Im Lauf seines langen Lebens wurde er damit zu einem Pionier und Brückenpfeiler der deutschbrasilianischen Beziehungen. Sein Reichtum erlaubte es ihm, sich in Wentorf bei Hamburg einen großzügigen Wohnsitz zu schaffen und darüber hinaus eine Stiftung in Lüneburg zu gründen, wo er auf dem dortigen Johanneum zur Schule gegangen war. Bei alldem wurde er zum Ahnherr einer großen, bis heute lebendigen Familie.

Law enforcement at sea has become an increasingly important tool for combating transnational crime. Such law enforcement operations are commonly directed by multinational missions composed of military rather than police forces, and are often carried out in maritime areas not subject to national jurisdiction. Because of these characteristics, maritime law enforcement operations touch upon many unresolved human rights issues. In the present study, counter-piracy operations off the coast of Somalia and in the Indian Ocean serve as the quintessential example of how law enforcement measures taken at sea may fall short of international human rights standards. An unprecedented number of national and multinational missions have been deployed to counter the phenomenon of piracy off the coast of Somalia and in the region. Their mandate includes the arrest, detention and transfer for prosecution of piracy suspects. The book at hand examines the procedures pertinent to the decision whether to release piracy suspects, prosecute them in the seizing State or transfer them to a third State, and the detention regime pending such decisions. The study provides a critical analysis of the compatibility of these procedures with international law, first and foremost human rights law. Using piracy as an example, it demonstrates that the characteristics of national and multinational law enforcement at sea may lead to a deviation from certain human rights standards – standards that the States in question readily accept and apply in their land-based, territorial law enforcement operations. At the centre of the analysis are two unique case studies, which provide insight into the arrest, detention and transfer procedures in both a multinational context and a purely interstate setting. This work is a valuable contribution to legal scholarship dealing with the human rights dimension of maritime law enforcement operations. It is a useful, timely and innovative resource for both academics and legal practitioners alike, or any person interested in the applicability and scope of human rights norms in the maritime context.

Der Autor befasst sich mit den (verbands-)rechtlichen Grenzen einer privaten Super-Liga im europäischen Spitzenfußball. Er geht - ebenso wie der EuGH in der Rs. C-333/21 - der Frage nach, ob die UEFA konkurrierende Wettbewerbe regulieren und Klubs und Spieler für die Teilnahme an solchen Wettbewerben sanktionieren darf, um die etablierten Strukturen des europäischen Sportmodells zu schützen. Anders als der EuGH untersucht er dabei auch die Vereinbarkeit der neuen UEFA-Genehmigungsregeln für internationale Klubwettbewerbe (Ausgabe 2022) mit dem EU-Kartellrecht. Gegenstand der Arbeit ist zudem die unionskartellrechtliche Zulässigkeit einer geschlossenen europäischen Super-Liga.

Après avoir été détruite aux deux tiers de son tonnage pendant la seconde guerre mondiale, la Marine marchande française s’est reconstituée en moins de cinq ans. Elle a dû faire face, d’une part à la disparition de ses paquebots de ligne avec l’arrivée sur l’Atlantique nord des premiers avions long-courriers à réaction, d’autre part à la perte de substance du trafic des marchandises sur ses lignes traditionnelles, avec la décolonisation. Précédant en cela les dirigeants des grandes entreprises exportatrices françaises, les armateurs et le personnel navigant, dans leur conquête de nouveaux marchés, ont été confrontés à la question suivante : comment continuer à vivre avec le même niveau de protection sociale et de prévoyance et affronter de manière efficace et équitable la concurrence internationale ? Jusqu’à la fin des années 1970, la flotte française a relevé le défi, multipliant son tonnage par trois et passant en 1975 du 10e au 9e rang mondial. Cependant, après 1980, aux effets de la deuxième crise pétrolière s’ajoutent d’autres facteurs négatifs dont l’absence d’une politique maritime stable. La Marine marchande française connaît alors une récession suivie d’une stabilisation dans les années quatre-vingt-dix. Bernard Cassagnou décrit et explique ces deux grandes mutations, l’une positive, l’autre négative. Et comme le souligne Alain Plessis : « Il ne nous fait pas seulement découvrir ce secteur, sur lequel ce livre constitue désormais une référence obligée, il apporte une contribution à prendre en compte pour donner des réponses aux questions fondamentales que soulève l’histoire économique de la France contemporaine ». L'originalité de ce livre est de proposer sur le temps long, de l'Antiquité à la fin du XVIIIe siècle, une étude de la place occupée par le monde de la mer dans le jeu politique des cités portuaires. À l'époque romaine, les capitaines, les armateurs, les négociants maritimes possédant une certaine richesse étaient-ils inscrits dans les sénats locaux ? Quel était leur rôle dans la vie civique ? Aux époques médiévale et moderne la problématique évolue : ville-État ou détenant une large autonomie, simple ville portuaire, les enjeux sont différents : contrôler l'État ou dominer l'économie locale en s'assurant le pouvoir municipal qui maîtrise l'administration des activités portuaires, s'assurer la prééminence politique. Pourtant la communauté professionnelle maritime se stratifie et éclate socialement et politiquement. Le temps des officiers qui pouvaient porter l'un des leurs au pouvoir laisse la place à une communauté de navigants de plus en plus exclue du jeu politique par une élite de brasseurs d'affaires maritimes qui s'accapare l'État dans les villes italiennes ou dans les villes de l'Europe septentrionale, sans éliminer toute contestation du monde des métiers ou d'un État central qui s'affirme, réduisant bientôt sa sphère d'intervention. Or, à l'époque du négoce triomphant, elle doit aussi tenir compte du rapport de force avec le monde de l'office et de la noblesse qui n'est pas insensible aux réussites que procurent les activités maritimes, l'attractivité n'étant pas à sens unique. L'ouvrage analyse tout autant les logiques qui expliquent la fermeture des conseils municipaux aux gens de mer que celles qui, au contraire, sont favorables à l'entrée des marchands dans la société politique locale.
