Abstract

A través de esta obra, se busca dar respuesta al porqué después de tres décadas de Convención sobre los Derechos del Niño, aún no hemos alcanzado la tutela efectiva de estos. El interés superior del niño, columna vertebral de la Convención e insigne expresión de los defensores de la infancia, ha propiciado una revolución ideológica que aún no concluye. Su recepción en los contextos nacionales ha logrado potencializar sus efectos, siempre y cuando la técnica legislativa que le acoge sea la adecuada. El estudio de derecho comparado que esta obra presenta pone de relieve los aciertos y desatinos que algunos países han experimentado, tratando de reducir al máximo el grado de discrecionalidad en la aplicación del interés superior, principal reto a superar en pleno siglo XXI.

Abstract

The ISMU annual Report on migration enters its 27th edition in 2022. Over time, the Report has become a useful reference for people working on migration, both within and outside Italy. This edition analyzes both the impact of the pandemic on migration flows and immigrants and the consequences of the Afghan crisis on migration. As the health emergency subsided in the second half of 2021, public interest on migration resurfaced along with the challenges that migration poses to Italy and the European Union. In addition to the traditional areas of interest (health, work, education, and the legal framework) and to statistical aspects (ISMU estimates that 5,576,000 foreigners live permanently in Italy as of 1st January 2021), the 27th edition of the Report devotes particular attention to the attitudes and orientations of Italian people towards migration, as well as to the experience of migrant women in terms of discrimination and positive valorization. The volume contains in-depth studies on refugees and humanitarian action, on how migration affected local elections, on alternatives to detention, and on foster care for unaccompanied foreign minors. Finally, special attention is devoted to Europe – especially to new directions in EU migration policy after Merkel – and the world – especially bilateral political initiatives involving African countries.

Abstract

On enseigne dans nos universités que la caractéristique principale du mineur est son incapacité générale. Il est effectivement soumis à l'autorité parentale et "bénéficie" du régime de représentation pour tous les actes un tant soit peu importants. Ce principe est cependant de moins en moins la règle absolue. Le législateur a introduit un certain nombre d'exceptions au principe d'incapacité. Diverses juridictions ont rappelé que le régime d'incapacité est fondé sur une nécessité de protéger le mineur qui n'a pas un total discernement pour poser des actes en toute connaissance de cause. La Convention des droits de l'enfant vient également rappeler que le mineur est titulaire de droits fondamentaux, tels le respect de sa vie privée, de sa correspondance et de son domicile, la liberté de pensée, de conscience et de religion, le droit d'association,... Il a paru utile de faire le point de la question à la lumière de l'évolution de la législation et de la jurisprudence.

Abstract

Up until the latter years of the twentieth century, there was very little critical analysis of child protection policies and practices. The core assumption was that it was concerns about child abuse and neglect that provided the rationale and focus for child protection policies, practices, and systems, and they were assumed to be benign in both intent and impact. Increasingly, however, it has been recognised that a whole range of political, cultural, and sociological influences bear on the development and operation of child protection policies, practices, and systems and that these can have a whole range of negative consequences. The aim of this edited book, based on the Special Edition of the same title, is to provide a range of international cutting-edge papers that critically analyse different aspects of child protection, and which also provide suggestions about how child protection can be positively reformed.

Abstract

This book, a Special Issue of the International Journal of Environmental Research and Public Health, has been curated by three leading international experts on the topic. Following their editorial, there are 14 contributions on the topic of interventions against bullying, including cyberbullying, and similar abusive behaviors such as dating violence. Some contributions also assess positive or protective factors such as well-being, self-efficacy, and school climate. Eight of the contributions directly assess the effects of an intervention, with pre/post test designs and experimental and control groups. The other contributions examine a range of relevant topics, such as teacher attitudes and pupils’ confidence in intervening rather than being passive bystanders. Ten countries are represented among the authors. Most of the articles are about secondary schools (pupils, or teachers), but there are also contributions on early childhood, primary school, and university. This book will be of interest and relevance not only to researchers but also to teachers and educational practitioners concerned with pupil safety and well-being in school, and provides practical ways to reduce bullying and its harmful effects.

Children and Drug Safety traces the development, use, and marketing of drugs for children in the twentieth century, a history that sits at the interface of the state, business, health care providers, parents, and children. Abstract

This edited collection brings together a diverse set of original research and review articles that contribute towards a unified objective of redesigning the future health workforce.
