"Reflecting on some of Brazil's foremost challenges, this book considers the sometimes porous relationship between legality and illegality in a country that is undergoing significant political and societal change. It brings together work by established scholars from Brazil, Europe and the United States to think through how (il)legalities are produced and represented at the level of institutions, (daily) practice, and culture. Through a transdisciplinary approach, the chapters cover issues including informal work practices (e.g. street vendors), urban squatter movements and (il)legal building in the cities' favelas, migration, strikes and social movements traditionally demonized. Abstract

In the media, migrants are often portrayed as criminals; they are frequently dehumanized, marginalized, and unable to share their experiences. Telling Migrant Stories explores how contemporary documentary film gives voice to Latin American immigrants whose stories would not otherwise be heard. The essays in the first part of the volume consider the documentary as a medium for Latin American immigrants to share their thoughts and experiences on migration, border crossings, displacement, and identity. Contributors analyze films including Harvest of Empire, Sin país, The Vigil, De nadie, Operation Peter Pan: Flying Back to Cuba, Abuelos, La Churona, and Which Way Home, as well as internet documentaries distributed via platforms such as Vimeo and YouTube. They examine the ways these films highlight the individual agency of immigrants as well as the global systemic conditions that lead to mass migrations from Latin American countries to the United States and Europe. The second part of the volume features transcribed interviews with documentary filmmakers, including Luis Argueta, Jenny Alexander, Tin Dirdamal, Heidi Hassan, and María Cristina Carrillo Espinosa. They discuss the issues surrounding migration, challenges they faced in the filmmaking process, the impact their films have had, and their opinions on documentary film as a force of social change. They emphasize that because the genre is grounded in fact rather than fiction, it has the ability to profoundly impact audiences in a way narrative films cannot. Documentaries prompt viewers to recognize the many worlds migrants depart from, to become immersed in the struggles portrayed, and to consider the stories of immigrants with compassion and solidarity.

Abstract

How Latinx kids and their undocumented parents struggle in the informal street food economy Street food markets have become wildly popular in Los Angeles—and behind the scenes, Latinx children have been instrumental in making these small informal businesses grow. In Kids at Work, Emir Estrada shines a light on the surprising labor of these young workers, providing the first ethnography on the participation of Latinx children in street vending. Drawing on dozens of interviews with children and their undocumented parents, as well as three years spent on the streets shadowing families at work, Estrada brings attention to the unique set of hardships Latinx youth experience in this occupation. She also highlights how these hardships can serve to cement family bonds, develop empathy towards parents, encourage hard work, and support children—and their parents—in their efforts to make a living together in the United States. Kids at Work provides a compassionate, up-close portrait of Latinx children, detailing the complexities and nuances of family relations when children help generate income for the household as they peddle the streets of LA alongside their immigrant parents.

A comprehensive look at the world of illicit trade Though mankind has traded tangible goods for millennia, recent technology has changed the fundamentals of trade, in both legitimate and illegal economies. In the past three decades, the most advanced forms of illicit trade have broken with all historical precedents and, as Dark Commerce shows, now operate as if on steroids, tied to computers and social media. In this new world of illicit commerce, which benefits states and diverse participants, trade is impersonal and anonymized, and vast profits are made in short periods with limited accountability to sellers, intermediaries, and purchasers.Louise Shelley examines how new technology, communications, and globalization fuel the exponential growth of dangerous forms of illegal trade-the markets for narcotics and child pornography online, the escalation of sex trafficking through web advertisements, and the sale of endangered species for which revenues total in the hundreds of millions of dollars. Abstract

Les questions migratoires sont à l’avant-plan de la scène politicomédiatique mais aussi législative. Sous l’impulsion du droit européen ou d’initiative nationale, les réformes sont nombreuses et imposent aux praticiens une mise à jour constante. L’ouvrage ne couvre pas l’actualité du droit de l’immigration de manière exhaustive mais aborde plusieurs thématiques ayant fait l’objet de réformes récentes ou d’évolutions procédurales significatives. La première concorde avec la transposition de la directive permis unique, annoncée depuis plusieurs années. Elle est l’occasion de faire le point sur l’immigration économique. La deuxième revient sur le regroupement familial et sur les hésitations de la jurisprudence sur des questions importantes telles que l’origine des revenus pris en compte. La troisième fait le bilan des lois dites « ordre public » un an après leur entrée en vigueur. Enfin, la dernière s’arrête sur la confrontation de la définition du réfugié et du protégé subsidiaire à la réalité géopolitique du conflit armé qui est à l’origine de la majeure partie des déplacements forcés. La guerre en Syrie, les conflits persistants dans plusieurs pays, comme l’Irak ou le Soudan, amènent les instances d’asile à évaluer le niveau de violence aveugle ou de craintes de groupes alors que le profil des demandeurs de protection était auparavant plus individuel. Outre le souci de se mettre à jour en droit positif, ces analyses sont l’occasion de poursuivre l’indispensable réflexion que le droit de l’immigration exige quant à l’équilibre entre les droits individuels et l’intérêt collectif allégué.

Abstract

La politique migratoire de l'Union européenne soulève depuis une décennie de vives critiques, soit en raison de son caractère laxiste, soit au contraire par l'atteinte portée aux droits de l'Homme. Cet ouvrage comportant les contributions d'un colloque s'étant déroulé à Dijon en 2016 se propose d'aborder les réels enjeux du traitement des flux migratoires sous son double aspect économique et politique. Il s'agit d'examiner comment le droit de l'Union européenne, en s'efforçant de rapprocher les législations des États membres, offre des réponses tant en matière d'asile que d'immigration économique, et d'apprécier si les valeurs contenues notamment dans la charte des fondamentaux sont préservées. Le point de départ de cette réflexion collective relève d'un constat : des centaines de milliers de demandeurs d'asile et d'immigrés économiques viennent échoir aux frontières de l'Union européenne, comment, alors, le droit européen régit-il une telle situation ? Compétences partagées entre les États membres et l'Union européenne, la gestion des flux migratoires forme un vaste écheveau vecteur de confusions. Sur cette politique s'enchevêtrent de nombreuses dispositions issues des traités, des accords de Schengen, du droit dérivé, et du droit national. C'est pourquoi, s'interroger sur la politique migratoire de l'Union européenne constituait un point focal sur la capacité des États membres de s'entendre sans méconnaître les principes de solidarité et de loyauté au cœur de la construction européenne.
