Productveiligheid en productaansprakelijkheid zijn niet weg te denken in onze maatschappij. Te denken valt aan elektronicaproducent Philips, die miljoenen Senseo-koffiezetapparaten terugriep wegens ontploffingsgevaar. De dramatische gebeurtenissen als gevolg van het DES- en het Thalidomide-schandaal zullen bij velen eveneens nog vers in het geheugen liggen. Tot slot kan gewezen worden op de verschillende product recalls van wagens door de jaren heen. De (Europese) wetgever is terecht meer aandacht gaan besteden aan reglementering omtrent productveiligheid en productaansprakelijkheid. Dit boek beoogt een heldere doch kritische analyse van het complex wetgevend kader inzake productveiligheid en het daarmee onlosmakelijk verbonden productaansprakelijkheidskader. Hierbij komt een duidelijke afbakening van het toepassingsgebied van beide reglementeringen aan bod. Nadien volgt een uitvoerige bespreking van het juridische veiligheidsbegrip: wat is juridisch gezien een (on)veilig product en welke beoordelingselementen zijn hierbij van belang? Vervolgens worden de belangrijkste handhavingsmiddelen die ter beschikking staan ten aanzien van (potentieel) onveilige producten geanalyseerd. De specifieke productaansprakelijkheidswetgeving neemt hierbij een prominente plaats in. Tot slot volgt een bespreking van de preventieve en de corrigerende maatregelen die de verschillende schakels in het productie- en distributieproces alsmede de overheid moeten nemen ten aanzien van (potentieel) onveilige producten

Volgens de huidige leer is men aansprakelijk voor de schade die wordt veroorzaakt door de gebrekkige zaken waarover men de bewaring heeft. Vele aansprakelijkheden worden door rechters op die manier uitgelegd, zoals onder meer deze voor schade door vallende bomen, brekende nutsleidingen en obstakels op de weg. In dit boek wordt aangetoond dat deze uitleg niet voor al deze aansprakelijkheden even gepast is. In werkelijkheid worden ook andere aansprakelijkheden toegestaan dan deze voor schade veroorzaakt door de gebrekkige zaken zelf. Door de algemeen gangbare leer te toetsen aan de beslissingen die rechters in werkelijkheid nemen, maakt Jochen Tanghe een originele en verfrissende analyse van een leerstuk dat dringend toe was aan verduidelijking. Aan de hand van vele voorbeelden toont de auteur aan dat sommige algemeen aanvaarde leerstellingen over het gebrek van de zaak niet overeenstemmen met de beslissingen die rechters blijken te nemen. Na een deconstructie wordt de theorie over het gebrek van de zaak weer opgebouwd. Daarbij wordt aansluiting gevonden bij algemene principes over aansprakelijkheid en worden ook verbanden gelegd met andere begrippen zoals oorzakelijkheid en bewaring. Dit boek is in het bijzonder interessant vanwege zijn unieke benadering. De juridische leer wordt niet beschouwd als een onwankelbaar geheel van directieve regels, maar wel als een wetenschappelijk-descriptieve omschrijving van de juridische realiteit, waarvan de accuraatheid kan worden getoetst aan rechterlijke beslissingen. Om die reden is het boek niet alleen interessant voor rechters, advocaten en andere praktiserende juristen, maar vormt het ook een voortreffelijke bijdrage aan de rechtswetenschap. Dit boek is de handelsversie van het proefschrift waarmee Jochen Tanghe in 2021 aan de Universiteit Gent promoveerde tot Doctor in de Rechten onder promotorschap van prof. dr. Marc Kruithof. Momenteel is hij doctor-assistent in het vakgebied schadevergoedingsrecht.

Thirty years after the entry into force of the Directive on liability for defective products (Council Directive 85/374/EEC), and in the light of the threat to user safety posed by consumer goods that make use of new technologies, it is essential to assess and determine whether the Directive remains an adequate legal response to the phenomenon of products brought to market that fail to ensure appropriate levels of safety for their users.European Product Liability is the result of an extensive international research project funded by the Polish National Science Centre. It brings together experienced scholars associated with the European Group on Tort Law (EGTL) and the European Research Group on Existing EC Private Law (Acquis Group). Individual country reports analyse the implementation of the Directive in the domestic law of several EU and EEA Member States (namely Austria, Czech Republic, Denmark, England, France, Germany, Italy, Netherlands, Norway, Poland, Spain, and Switzerland) and the relationship of the implemented rules with the already existing rules of tort law. The country reports show that the practical significance of product liability differs widely in the various Member States. Also taking into account non-EU countries (Canada, Israel, South Africa and the USA), this book examines whether EU law will ensure sufficient safety for individuals using goods that have been produced using new technologies that are currently under development, such as major advances in mechatronics, nanotechnology, regenerative medicine and contour crafting. Together with an economic analysis of product liability it makes the book valuable for academics, practitioners, policy makers and all those interested in the subject.
