Depuis près de deux siècles, le droit d'auteur a connu en Europe, et ensuite au niveau mondial, un développement qui s'accélère tant dans les textes applicables qu'en jurisprudence et en doctrine. S'y ajoute l'évolution de droits des artistes-interprètes ou exécutants, des producteurs de phonogrammes et des premières fixations de films ainsi que des organismes de radiodiffusion. Les programmes d'ordinateur et les banques de données sont venus s'inscrire dans ce domaine juridique à côté des catégories traditionnelles d'œuvres dont l'étendue est à la mesure des domaines où s'exprime l'esprit créateur, y compris l'architecture et le "design". L'ouvrage analyse ces questions en droit belge (notamment les deux lois du 30 juin 1994), en droit européen et en droit international. Les produits multimédia, les nouvelles technologies et Internet suscitent divers débats que l'ouvrage replace dans le cadre conceptuel approprié. De nombreuses annexes reproduisent, en français et en néerlandais, tous les textes belges et internationaux utiles.

Het is een courante praktijk om op grond van de regels inzake verwarringstichting, misleiding en aanhaking in de Wet Handelspraktijken bescherming te zoeken voor intellectueelrechtelijk niet-beschermde prestaties. Er is een belangrijke strekking in rechtspraak en rechtsleer die stelt dat een dergelijke bescherming buiten de wettelijke intellectueelrechtelijke beschermingregimes niet mogelijk is. Dit fenomeen wordt ook wel aangeduid als de “reflexwerking” die uitgaat van de intellectuele rechten. Deze werking komt erop neer dat, ook al geniet een prestatie geen intellectueelrechtelijke bescherming omdat de (inhoudelijke of formele) voorwaarden daarvoor niet zijn vervuld, er toch een doorwerking van de intellectuele rechten kan plaatsvinden die de toepassing van andere bepalingen, zoals die van de Wet Handelspraktijken, kan uitsluiten. De auteur analyseert de rechtspraak ter zake en gaat de precieze wettelijke basis van dit principe na. De auteur komt daarbij tot het besluit dat de reflexwerking niet consequent door de hoven en rechtbanken wordt toegepast en dat enkele internationale rechtsinstrumenten die in een bescherming op grond van de regels inzake oneerlijke mededinging voorzien, een grond van bescherming kunnen vormen onafhankelijk van het al dan niet bestaan van een intellectueelrechtelijke bescherming.

Vooreerst wordt het begrip domeinnaam uitgediept. Hierbij wordt o.a. aandacht besteed aan het internationale kader en de verschillende soorten domeinnamen. Daarna bespreekt de auteur de domeinnamen in het Belgisch vermogensrecht (overdracht, pand, beslag). De geschillen, die kunnen ontstaan m.b.t. de domeinnamen komen vervolgens en stelselmatig aan bod, met aansluitend een gestructureerd overzicht van de alternatieve geschillenbeslechting en de gerechtelijke procedures. De verschillende proceduremogelijkheden worden geïllustreerd met tal van modellen en voorbeelden. In een laatste hoofdstuk wordt ingegaan op de zeer recente Belgische wet inzake het wederrechtelijk registreren van domeinnamen. The economic importance of innovative activity brings with it an active debate on public policy's effect on the innovation process.
