Postgraduate thesis defended in 1980, this monographic study concerns the realization in the oasis of Damascus of the great agrarian reform which took place in Syria from the end of the 1950s.Anne-Marie Bianquis begins by presenting data general information on this agricultural region (physical elements, landscape, hydraulic arrangements, settlement, agrarian structures) to then retrace its history and that of Syria since the end of the Ottoman Empire. His work then focuses on the land reform legislation in its various stages as well as its successive phases and applications in the oasis. Based on documentation from both the Ministry of Agriculture and Agrarian Reform and numerous field surveys, the author takes stock of the processes of expropriation, land redistribution, creation of cooperatives and constitution. of a public agricultural sector. The last pages take stock of these reforms. They also recall the economic upheavals that hit the region at the end of the 1970s - in particular the two oil shocks - and their role in the reconfiguration of the oasis, which then tends more and more to urbanize.

How does a popular uprising transform itself from the disorder of revolution into a legal system that carries out the daily administration required to govern? Americans faced this question during the Revolution as colonial legal structures collapsed under the period's disorder. Yet by the end of the war, Americans managed to rebuild their courts and legislatures, imbuing such institutions with an authority that was widely respected. This remarkable transformation came about in unexpected ways. Howard Pashman here studies the surprising role played by property redistribution-seizing it from Loyalists and transferring it to supporters of independence-in the reconstruction of legal order during the Revolutionary War. Building a Revolutionary State looks closely at one state, New York, to understand the broader question of how legal structures emerged from an insurgency. By examining law as New Yorkers experienced it in daily life during the war, Pashman reconstructs a world of revolutionary law that prevailed during America's transition to independence. In doing so, Pashman explores a central paradox of the revolutionary era: aggressive enforcement of partisan property rules actually had stabilizing effects that allowed insurgents to build legal institutions that enjoyed popular support. Tracing the transformation from revolutionary disorder to legal order, Building a New Revolutionary State gives us a radically fresh way to understand the emergence of new states.

Las ciudades argentinas y latinoamericanas presentan una importante conflictividad social por el acceso y la tenencia del suelo urbano. Una manifestación de esa problemática son las tomas de tierra y los procesos de autoproducción de barrios por parte no solo de sectores populares, sino también de capas medias de la población. Otro aspecto de este conflicto es la existencia de tierras que, loteadas en un pasado lejano, están en situación de abandono por propietarios ausentes. Y cabe entonces preguntarse: ¿pueden coexistir propiedades abandonadas con demandas insatisfechas de suelo urbano? Y en todo caso, ¿cómo puede intervenir el Estado ante un andamiaje legal que protege la propiedad sin propietario? Los autores de este libro buscan develar el origen de esta situación paradójica y contribuir a la intervención del Estado a favor de la ampliación del acceso al suelo urbano. Asimismo, para no quedarse en el plano meramente analítico, proponen el estudio del caso de la ciudad de San Carlos de Bariloche y una forma de resolución a partir de una herramienta legislativa concreta.

De twee bijdragen in dit boek behandelen de zelfrealisatie door particulieren van plannen die door een overheid werden uitgewerkt en vastgelegd. Tot op heden werd aan de mogelijkheid tot zelfrealisatie van overheidsprojecten door privatieve eigenaars weinig aandacht besteed. 0In een eerste reflex denkt men bij zelfrealisatie enkel aan lucratieve projecten zoals bijvoorbeeld groepswoningbouw, verkavelingen of het ontwikkelen van industrieterreinen. Maar ook niet-winstgevende projecten kunnen voor private realisering in aanmerking komen. Zo verhindert niets dat bijvoorbeeld een natuurgebied of een bufferzone particulier gerealiseerd wordt. Of dit realistisch en/of haalbaar is, is natuurlijk een andere vraag. Voor zover een eigenaar zelf in staat is om een welbepaald door de overheid voorgenomen project te realiseren op de wijze die de overheid voor ogen heeft, is een onteigening in functie van dat werk overbodig. 0Erika Rentmeesters bespreekt de reglementering in Vlaanderen en Willem van der Werf geeft zijn visie over de zelfrealisatiemogelijkheden door particulieren in Nederland. Beide auteurs gaan gedetailleerd in op de juridische en feitelijke omstandigheden en de voorwaarden die bij het principe van zelfrealisatie aan de orde komen. Ze maken daarbij tevens de nodige afwegingen bij het verband tussen de zelfrealisatie en de noodzaak tot onteigening.0.

Through the emergence of several high-profile investment arbitration cases, the effects of IPRs as investments covered under IIAs have finally come to light. The latest award, the only arbitration case dealing with patents as IPRs – the Eli Lilly v. Canada case – has brought up a number of interesting questions. Two of Eli Lilly's patents have been revoked, whereupon the company tried to redeem them through investment arbitration. One of the claims put forward by Eli Lilly is that his legitimate expectations, a standard of protection found in international investment law, have been frustrated by Canada. By allegedly failing to observe its obligations contained in Chapter 17 of the NAFTA, Canada frustrated the legitimate expectations of Eli Lilly. The thesis tries to analyze how the relationship between international IP treaties and legitimate expectations functions.
