Die Frühe Neuzeit zeichnet sich dadurch aus, dass sich gesellschaftliches Leben in symbolischen Akten ereignete. Erst durch konkrete Ereignisse traten das Reich und damit auch die Reichsjustiz in Erscheinung. Voraussetzung war die Vermittlung durch Medien im Sinne von Bild, Schrift und gesprochenem Wort. Der vorliegende Sammelband stellt erstmals dar, wie Gericht- und Rechtsprechung in der Frühen Neuzeit medial vermittelt wurden. Themenschwerpunkte sind u.a. die Visualisierung des Reichskammergerichts am Beispiel der Audienz und das Bild der Höchstgerichtsbarkeit in deutschen Chroniken, aber auch die Funktion und Ausgestaltung des Kommunikationsprozesses zwischen Kläger, Beklagtem und Gericht, u. a. auch am Beispiel der Familie Fugger. Der Kommentar zum Arbeitsgerichtsgesetz (ArbGG) ist eine kompetente Arbeitshilfe zur Beantwortung verfahrensrechtlicher Fragen im Arbeitsrecht, die auch wissenschaftlichen Ansprüchen genügt. Er enthält ausführliche Darstellungen zu den arbeitsrechtlichen Verfahren vor dem BVerfG und dem EuGH sowie dem Einigungsstellenverfahren. Neben der aktualisierten Rechtsprechung und Literatur wurden folgende Gesetze neu eingearbeitet: Tarifeinheitsgesetz Gesetz zur Einführung der elektronischen Akte in der Justiz und zur weiteren Förderungdes elektronischen Rechtsverkehrs 6. What are drug courts? Do they work? Why are they so popular? Should countries be expanding them or rolling them back? These are some of the questions this volume attempts to answer. Simultaneously popular and problematic, loved and loathed, drug courts have proven an enduring topic for discussion in international drug policy debates. Starting in Miami in the 1980s and being exported enthusiastically across the world, we now have a range of international case studies to re-examine their effectiveness. Whereas traditional debates tended towards binaries like “do they work?”, this volume attempts to unpick their export and implementation, contextualising their efficacy. Instead of a simple yes or no answer, the book provides key insights into the operation of drug courts in various parts of the world. The case studies range from a relatively successful small-scale model in Australia, to the large and unwieldy business of drug courts in the US, to their failed scale-up in Brazil and the small and institutionally adrift models that have been tried in England, Scotland, Wales and Ireland. The book concludes that although drug courts can be made to work in very specific niche contexts, the singular focus on them as being close to a “silver bullet” obscures the real issues that societies must address, including (but not limited to) a more comprehensive and full-spectrum focus on diverting drug-involved individuals away from the criminal justice system.

Présentant une version enrichie des actes du colloque international organisé à Aix-en-Provence en juin 2016, cet ouvrage explore la possibilité de franchir une nouvelle étape au sein du système de justice constitutionnelle français, par la mise en place d'un contrôle de constitutionnalité des décisions de justice. Au regard de l'introduction récente de la QPC, un tel questionnement pouvait paraître surprenant, car l'adoption d'une telle procédure a été considérée comme un réel progrès pour l'État de droit français. Toutefois, malgré le succès remarquable de la QPC, il est apparu légitime de se demander si l'objectif affiché par la réforme, à savoir celui d'ouvrir une nouvelle voie de recours aux justiciables pour assurer la protection de leurs droits fondamentaux, avait bien été atteint. Or, l'analyse du fonctionnement concret de la QPC laisse apparaître des difficultés, notamment en ce qui concerne le filtrage opéré par les juridictions administratives et judiciaires, et des angles morts du contrôle de constitutionnalité. L'objectif poursuivi par le colloque était double : d'une part, tirer les leçons du fonctionnement des systèmes étrangers qui pratiquent un contrôle de la constitutionnalité des décisions de justice, en vérifiant si ce contrôle est une véritable plus-value pour la protection des droits et libertés et, d'autre part, vérifier l'état du système de justice constitutionnelle français après cette réforme capitale, tout en s'interrogeant sur ses possibles perfectionnements.
