Die Kaiser Augustus, Mark Aurel, Septimius Severus und Caracalla sind vor allem durch ihre Politik bekannt. Daneben waren sie als Kaiser auch in der Rechtsprechung tätig. Wie sie diese wahrnahmen, prägt auch ihre spätere Einschätzung in der Literatur bis heute. Dieser Band befasst sich mit Berufungsentscheidungen der römischen Kaiser, wenn sie gegen eine bereits gefällte Entscheidung angerufen wurden. Vom vorsichtigen Lavieren des Kaisers Augustus zur Einrichtung dieser Instanz bis zum Spiel Caracallas mit der inzwischen etablierten Berufungsinstanz zeigen sich verschiedene Vorgehensweisen. Im Mittelpunkt stehen dabei der Weg zum Urteil in Verhandlung und Beratung sowie der Aufbau der Entscheidungen im Wechselspiel zwischen juristischer Argumentation und politischer Rhetorik. Als Quellen dienen dabei Inschriften, die wegen ihrer Bedeutung auf dem Marktplatz in Athen oder an Tempelmauern in Dmeir angebracht wurden, sowie die Überlieferung wichtiger Entscheidungen in den Digesten, einem Teilstück des Corpus Iuris Civilis. In letzteren finden sich Quellen, in denen die ausführliche rechtliche Auseinandersetzung im Konsilium geschildert wird. Dort waren zum Teil berühmte Juristen wie Paulus und Papinian vertreten, die kein Blatt vor den Mund nahmen und die Entscheidung des Kaisers vorbereiteten oder auch kritisierten. Die Beteiligung der Parteien am Rechtsfindungsprozess wird ebenso deutlich wie der rhetorische Diskurs zwischen allen Beteiligten. Gerade dieser Diskurs mit Prozessbeteiligten und Beratungsgremium zeigt den doch stets bestehenden Kontakt zwischen Kaiser und Volk. Die Anhörung der Partei und die Vorbereitung des Urteils durch intensive Beratung haben sich als zentrale Elemente der kaiserlichen Urteile erwiesen.
