Abstract

This book examines the rapidly expanding EU agency's distinct role in EU border control, showing that Frontex is a prominent border control actor that reshapes the EU borders by promoting a new border control culture. Bringing culture into the analysis of Frontex, this book offers an alternative in-depth understanding of the agency's function, focusing on the production and diffusion of border control assumptions and practices within a border control community. Based on data drawn from primary research at Frontex and two EU external borders, namely Lampedusa and Evros, this book examines Frontex's contribution to the emergence of a new border control culture in Europe, replacing the pre-existing Schengen culture. Compared with the existing literature on Frontex, this novel account takes into consideration the evolving nature of borders and border control, discussing three contemporary challenges for the established border control regime: Brexit, the COVID-19 pandemic, and hard security preoccupations, such as the fall-out from the Russian invasion in Ukraine and the weaponisation of migration at the Greek-Turkish land border. Frontex and the Rising of a New Border Control Culture in Europe will appeal to scholars and students of border management, EU studies, migration, geography, international relations, and security, along with policymakers and practitioners with an interest in EU border control and Frontex.

Simon et Julie, sénégalais, mariés, ont un fils au pays et deux enfants à Paris : sans papiers pendant huit ans, ils sont régularisés au motif de leur "vie privée et familiale". Hortense vient des Philippines ; mère célibataire d'une fille née à Paris, elle vit durant huit ans sans papiers avant d'être régularisée pour "cinq ans de présence prouvée et un enfant scolarisé depuis au moins trois ans".C'est en accompagnant au quotidien ces femmes et ces hommes qui, à un moment de leur vie, se trouvent en "situation administrative irrégulière", que Frédérique Fogel a enquêté. Pendant dix années, sous plusieurs régimes réglementaires et législatifs, elle a questionné les pratiques et les représentations des relations de parenté et des liens de famille de part et d'autre du guichet préfectoral : comment parler parenté et Faire famille dans la situation d'une migration immobilisée ? Comment la condition sans papiers influence-t-elle les relations entre celles et ceux qui vivent en migration et leur famille au pays ? Comment le dispositif juridique infléchit-il la vie privée, imposant certaines manières d'être et de penser ? Cette recherche ethnographique et anthropologique interroge également la marginalité et la précarité juridiques des personnes étrangères, apportant un éclairage nouveau sur l'évolution des normes en usage sur le territoire français en matière de parentalité, de conjugalité et de genre.Parenté sans papiers forme ainsi une contribution importante à une anthropologie des migrantes et des migrants, permettant de comprendre l'écart entre la famille sans papiers, contrainte à la normativité, et la famille sociologique "française" qui, depuis les années 1970, n'en finit pas de dépasser les normes.

Cette invitation est faite à des auteurs de plusieurs générations et de multiples horizons (historiens, critiques de cinéma, cinéastes, philosophes, anthropologues, programmateurs), dans un désir de partage, d' écritures vives et de réflexions impliquées. Le livre est publié à l'occasion de la rétrospective de l'ensemble de leurs films au Centre Pompidou (du 2 décembre 2021 au 2 janvier 2022). Il se termine avec les carnets de travail du prochain film, actuellement en montage, réalisé après le démantèlement de la Jungle, la lande étant désormais devenue une ' zone de renaturation '.

Abstract

Abstract

This is a study of the legal framework on criminal measures on trafficking and/or smuggling and facilitating illegal entry in six Member States: France, Germany, Italy, the Netherlands, Spain and the UK, and the European Union. This issue is at the nexus of migration and criminal law. The system of criminal law in the Member States is a central part of the balance of the powers of the authorities and the rights of the citizen. The way in which civil liberties of the individual are weighed in comparison with public protection duties by the authorities is in essence a constitutional issue. The treatment of foreigners, in particular as regards their entry onto the territory and residence is not part of the constitutional settlements, but a field governed by state discretion and exceptionalism. The rules and administrative measures regarding entry, residence and expulsion of foreigners is not subject to the same civil liberties guarantees of due process as apply in criminal law. This comparative study examines how, in each Member State, the insertion of immigration into criminal law takes place. Do the rules of criminal law in respect of due process take precedence over the lower evidential and procedural requirements which are applied in the field of immigration? How does the criminal justice system deal with this new field where central constitutional issues are not present? There are two levels on which the insertion of immigration into criminal law takes place – the legal and the social. This book deals with both. On the one hand it looks at the laws and the court decisions on criminal trials in respect of immigrants for immigration related offences, on the other hand it looks at how the society (political actors, media, interest groups etc) discuss and develop this issue. This book is designed for policymakers, academics, students and activists concerned about the European Union.
