Op 1 september 2013 trad de nieuwe Belgische arbitragewet van 24 juni 2013 in werking. Deze wetgeving is gebaseerd op de wereldwijd beproefde ‘UNCITRAL Modelwet’ en vervangt dus integraal de oude arbitragewet van 1972. De Belgische wetgever heeft zich uiteraard wel bediend van de jarenlange ervaring van de Belgische rechtspraak en rechtsleer inzake arbitrage en integreerde een aantal typisch Belgische elementen in deze nieuwe wet. Toch bevat de recente arbitragewet een aantal fundamentele nieuwigheden. Deze hebben alle tot doel het optimale verloop van de arbitrage te garanderen en zo van België een aantrekkelijke plaats voor arbitrage te maken. De auteurs behandelen een selectie van nieuwe wetsbepalingen en geven aan hoe deze een praktische inslag hebben op het verloop van arbitrage op het Belgische grondgebied. La justice étatique, comme la justice interétatique, possède des vertus indéniables. Les garanties qui lui sont inhérentes sont remarquables. Dans bien des situations, l’oeuvre accomplie est, par ailleurs, de nature à ramener la paix sociale, but suprême du droit. La justice étatique, comme la justice interétatique, pêche cependant par différents travers. La rigidité de la mécanique n’est pas de nature à garantir un accès des plus aisés au justiciable. Surtout, le temps nécessaire à rendre la justice ne correspond plus au temps des affaires et même à celui du citoyen. En l’absence de moyens financiers supplémentaires affectés à la justice, destinés à rencontrer les difficultés chroniques qu’affiche celle-ci, des modes alternatifs de résolution des conflits se font jour. Largement pratiqué dans d’autres champs du droit, l’arbitrage ne fait que timidement son entrée dans la sphère du droit public. En quoi l’arbitrage se concilie-t-il avec les particularités du droit public ? Dans quelle mesure l’arbitrage peut-il être utile à la satisfaction de l’intérêt général, auquel le droit public prête, tout entier, son concours ? Nourris de la comparaison des expériences belge, française et suisse, des apports de la pratique arbitrale dans les secteurs de la vie économique et internationale, mais aussi du recours émergent à d’autres modes alternatifs de résolution des conflits, l’ouvrage a pour objet de répondre à ces questions capitales dans l’organisation à venir de l’oeuvre de justice.
