Malgré tout, certains problèmes et difficultés demeurent. Tel en va ainsi de la pénurie d’organes : le nombre de greffons disponibles n’est pas suffisant pour faire face à la demande croissante des patients en attente. Cette situation engendre de nombreux efforts sur différents plans en vue de combattre le manque. À cette fin, il propose : une étude préalable du phénomène de pénurie d’organes, dans son existence, ses origines et ses prolongements - dont celui que constituent le trafic et le tourisme de transplantation ; une analyse détaillée de l’état actuel du droit applicable au prélèvement et à la greffe aux niveaux international et européen, d’une part, et national, d’autre part – dans le cadre de laquelle sont réalisés un examen des actions de l’OMS, du Conseil de l’Europe et de l’Union européenne, ainsi qu’une comparaison de la réglementation belge avec celles espagnole, américaine, croate et iranienne ; des propositions inédites quant au rôle à endosser par le droit face à la pénurie d’organes et à la délimitation concrète de celui-ci – qui pourraient mener à des modifications de l’encadrement juridique en Belgique ou inspirer les organisations internationales et les autorités d’autres pays. Cet ouvrage a vocation à s’adresser tant au monde juridique qu’au monde médical et plus généralement à toute personne intéressée par la problématique du don d’organes."
