"Dispelling rampant confusion about "hate speech," this book explains how U.S. law appropriately distinguishes between punishable and protected discriminatory speech. It shows that more speech-restrictive laws consistently have suppressed vital expression about public issues, targeting minority viewpoints and speakers; and that "counterspeech" has more effectively promoted equality and societal harmony"-- We live in an era in which offensive speech is on the rise. The emergence of the alt-right alone has fueled a marked increase in racist and anti-Semitic speech. Given its potential for harm, should this speech be banned? Nadine Strossen's HATE dispels the many misunderstandings that have clouded the perpetual debates about "hate speech vs. free speech." She argues that an expansive approach to the First Amendment is most effective at promoting democracy, equality, and societal harmony. Proponents of anti-hate speech laws stress the harms that they fear such speech might lead to: discrimination, violence, and psychic injuries. However, there has been no rigorous analysis to date of whether the laws effectively counter the feared harms. This book fills that gap, examining our actual experience with such laws. It shows that they are not effective in reducing the feared harms, and worse yet, are likely counterproductive. Even in established democracies, enforcement officials use the power these laws give them to suppress vital expression and target minority viewpoints, as was the case in earlier periods of U.S. history. The solution instead, as Strossen shows, is to promote equality and societal harmony through the increasingly vibrant "counterspeech" activism that has been flourishing on U.S. college campuses and in some global human rights movements. Comment articuler les exigences (ou le «droit») du public à accéder à l'information et le droit de limiter la reproduction donc la diffusion d'une oeuvre ? Comment laisser libre cours à l'expression parodique et en même temps maintenir le respect dû à une oeuvre ? Comment, de manière générale, concilier droit d'auteur et liberté d'expression ? Telles sont les questions auxquelles ce recueil entend répondre. Traditionnellement, les spécialistes du droit d'auteur, en tout cas en Europe, ne se sont pas fort intéressés aux tensions qui peuvent naître entre les exigences tirées de la liberté d'expression et la protection conférée par le droit d'auteur. Certains défenseurs du droit d'auteur professent même, ou pensent sans l'avouer publiquement, que le droit d'auteur devrait rester immunisé à l'encontre des revendications fondées sur la liberté d'expression. S'il n'est pas acceptable que le droit d'auteur soit placé par ses adeptes dans un sanctuaire, la liberté d'expression ne doit pas non plus être sanctifiée, particulièrement à une époque où les revendications sous couvert de liberté d'expression sont souvent émises par des opérateurs commerciaux pour travestir des intérêts plus vénaux. Dès lors que ni le droit d'auteur, ni la liberté d'expression ne devraient par principe l'emporter, il reste - tâche plus ardue - à déterminer le juste équilibre. C'est à cette recherche d'un équilibre que les contributions rassemblées dans le présent volume sont consacrées. Certaines émanent de spécialistes du droit d'auteur, d'autres de juristes des droits de l'homme, parfois elles rassemblent les deux. Tous les auteurs réunis proviennent de pays partiellement francophones et le recueil offre une palette d'approches «civilistes» sur la relation entre droit d'auteur et liberté d'expression.
