International affairs no longer constitute a separate, stand-alone policy area. They have come to permeate virtually every aspect of society, from their origins as primarily territorial, war and peace considerations to regulating everything from consumer protection to agriculture and the environment today; this phenomenon is amplified in the European Union where there is an extra layer of supra-national legislation. In the federal state structure, where material competences are attributed to both federal and component states, the difficult question arises as to which of these levels of government should act on the international stage. Federations have to find a balance between federal unity in international affairs on the one hand and component state autonomy in their attributed material competences on the other.
This question regarding the legitimacy of treaties has received insufficient attention until now. In this book, this fundamental question and its consequent permutations and impacts are addressed from a theoretical perspective as well as from a strictly legal perspective. The more abstract theoretical analysis put forth is then applied by way of reference to the example of the sensitive subject of double tax treaties. Whilst this book does not address fiscal federalism per se, it touches upon its externalization reflected in the division of treaty making power.

This work examines tax policies and tax systems as they arise from democratic choices, set against the background of a market economy. Professors Hettich and Winer find that democratic institutions yield complex tax systems with features that follow a varied but predictable pattern. In developing their analysis, the authors use formal modelling of voting behavior, emphasizing recent advances in the theory of probabilistic voting. This book differs from the available tax literature by relating fiscal choices directly to voting and by examining tax systems in democratic countries from a variety of perspectives. While the authors primarily focus on explaining observed features of tax systems, they also devote considerable space to the discussion of the welfare and efficiency effects of taxation in the presence of collective choice, and to a review of other models and of the related literature. In addition, they use computational general equilibrium analysis and statistical research on national and state governments in the US and Canada to link theory to empirical data.

Comparative Fiscal Federalism provides a full-scale comparative analysis of the tax jurisprudence of the judicial systems of the European Union (EU) and the United States (US). Judicial review of taxation in the world’s two most economically significant multistate systems has exposed a remarkable divergence. Although there are important differences between the competences of the two tribunals, the fact remains that the European Court of Justice (ECJ) has been much more aggressive in striking down Member State income tax rules than has the US Supreme Court in comparable cases. This book – now in an updated second edition – asks: Why this divergence? And what can the two tribunals learn from each other about adjudicating issues that arise from the interaction of tax regimes in the context of a single market?

[... la thèse est structurée en deux parties portant, respectivement, sur l'établissement de la compétence (Première partie) et sur l'exercice du pouvoir fiscal (Seconde partie). La première partie met bien en évidence l'origine de la compétence fiscale, à savoir l'État. Cela vaut non seulement dans l'ordre juridique international mais aussi dans l'ordre juridique interne. Le raisonnement est toutefois différent. Si la compétence fiscale de l'État tient à son existence même en tant que personne publique souveraine, ce qui écarte alors toute idée d'habilitation juridique à exercer le pouvoir fiscal, celle de ses organes, y compris ceux des collectivités infra-étatiques, repose sur une habilitation qui puise sa source, directement ou indirectement, dans sa Constitution.Sur ce point, et même si, sans toujours en retenir un contenu identique, la plupart des auteurs fiscalistes reconnaissent l'ambiguïté qui peut naître de son utilisation, la référence à la « souveraineté fiscale » pour une collectivité infra-étatique mériterait d'être reconsidérée, et abandonnée. [...] l'organisation administrative de la France présente une diversité révélant une échelle d'autonomie dans un cadre qui demeure celui fixé en amont par la Constitution de l'État.Consacrée à l'exercice du pouvoir fiscal, la seconde partie s'intéresse plus particulièrement à ses limites dans l'ordre juridique international. Le choix de l'intitulé, en lieu et place de « L'exercice de la compétence fiscale », s'explique par la différence, relevée et opérée par M. Kallergis, entre compétence et pouvoir. Ainsi entendue, la compétence étant le domaine d'exercice du pouvoir, c'est bien le pouvoir qui est exercé et non une compétence. [...] Rien n'exclut cependant que l'État, en tant que sujet de droit international, décide de s'engager dans un processus multilatéral, soit dans une perspective de coopération par la conclusion de conventions fiscales interétatiques, soit dans une perspective d'intégration, ce qui est le cas de l'Union européenne. Quelle que soit la voie choisie, l'État demeurant souverain, l'engagement n'étant jamais irréversible. [.. .] M. Kallergis nous livre une étude inédite dans son ampleur de la compétence fiscale mêlant théorie de l'État, droit international, droit de l'Union européenne, droit constitutionnel et droit administratif. Son apport ne se limite toutefois pas à sa démonstration. Il tient également à la richesse du contenu qui la soutient. L'étude de la relation entre le pouvoir fiscal et le territoire, souvent appréhendée dans une logique descriptive des régimes fiscaux intéressant l'imposition d'opérations transnationales, offre ainsi aux lecteurs de très intéressants développements, notamment historiques et éclairés par la jurisprudence étasunienne et britannique sur le régime applicable lorsque tout ou partie du territoire d'un État est sous occupation d'un autre État. [.. .] Servie par un appareil de références et une bibliographie de tout premier ordre en six langues (français, anglais, allemand, italien, espagnol et grec), la thèse de M. Kallergis fait partie de ces thèses structurantes dont la lecture ne peut qu'être recommandée à tout juriste fiscaliste soucieux d'en revenir aux fondamentaux. [...]
