Abstract

This book is the first comprehensive report and analysis of the Dutch euthanasia experience over the last three decades. In contrast to most books about euthanasia, which are written by authors from countries where the practice is illegal and therefore practised only secretly, this book analyzes empirical data and real-life clinical behavior. Its essays were written by the leading Dutch scholars and clinicians who shaped euthanasia policy and who have studied, evaluated and helped regulate it. Some of them have themselves practised euthanasia. The book will contribute to the world literature on physician-assisted death by providing a comprehensive examination of how euthanasia has been practised and how it has evolved in one specific national and cultural context. It will greatly advance the understanding of euthanasia among both advocates and opponents of the practice.

Abstract

This book, written both for a Canadian and an international readership, provides a multidisciplinary review of the framework and performance of the Canadian Medical Assistance in Dying (MAID) program. In the first five years (2015-2021) of operation, this program delivered voluntary euthanasia and assistance in suicide to over 30,000 Canadian residents, presently representing a 30% annual growth. Looking back on these first five years, the 30 Canadian scholars and clinicians contributing to this volume raise important issues and attempt to answer key questions that have arisen in regards to its operation and its stated objectives. This volume strikes the most appropriate balance between the autonomy of persons who seek medical assistance, versus the interests and protection of vulnerable persons. Finally, the book makes suggestions on how the program can presently be improved. It identifies gaps in knowledge about MAID’s operational program and its impact on individuals, families and society in order to stimulate the necessary research that is essential to the evolution of a healthy and well-balanced program. As a first, comprehensive examination of medically assisted deaths in Canada, this publication will be of great value to lay, professional, academic, political audiences both domestically and internationally, especially in jurisdictions that are examining their options of permitting assisted deaths.

Abstract

If it comes to choosing between methods of last resort for severely suffering, physician-assisted suicide will probably prove more acceptable as a method of last resort than active euthanasia both to patients, to legislators and to the general public. From the perspective of patients, physician-assisted suicide is a more unambiguous expression of the patient's autonomous will. From the legislator's perspective it seems less liable to misuse and abuse. And often the availability of assisted suicide, instead of shortening the life of a patient, has proved to prolong it. Public policy has begun to respond to this prospect. Notably in Switzerland and Germany, the attitudes of public bodies towards physician-assisted suicide are in a process of change, partly motivated by the wish to take the edge off the pressure for legalisation of active euthanasia. The present volume focuses on public policy issues related to physician-assisted suicide. It offers a detailed analysis of the current legal standing and practice of physician-assisted suicide in various countries and discusses the ethical principles underlying its legal and professional regulation. In addition, it contains a number of personal narratives by professionals who have for many years been involved in end-of-life issues.

Abstract

Does a competent person suffering from a terminal illness or enduring an otherwise burdensome existence, who considers his life no longer of value but is incapable of ending it, have a right to be helped to die? Should someone for whom further medical treatment would be futile be allowed to die regardless of expressing a preference to be given all possible treatment? These are some of the questions that are asked and answered in this wide-ranging discussion of both the morality of medically assisted death and the justifiability of making certain instances legal. A case is offered in support of the moral and legal permissibility of specified instances of medically assisted death, along with responses to the main objections that have been levelled against it. The philosophical argument is bolstered by empirical evidence from The Netherlands and Oregon where voluntary euthanasia and physician-assisted suicide are already legal.

Abstract

The first book length anthropological study of voluntary assisted dying in Switzerland, Leaving is a narrative account of five people who ended their lives with assistance. Stavrianakis places his observations of the judgment to end life in this way within a larger inquiry about how to approach and understand the practice of assisted suicide, which he characterizes as operating in a political, legal, and medical “parazone,” adjacent to medical care and expertise. Frequently, observers too rapidly integrate assisted suicide into moral positions that reflect sociological and psychological commonplaces about individual choice and its social determinants. Leaving engages with core early twentieth-century psychoanalytic and sociological texts arguing for a contemporary approach to the phenomenon of voluntary death, seeking to learn from such conceptual repertoires, as well as to acknowledge their limits. Leaving concludes on the anthropological question of how to account for the ethics of assistance with suicide: to grasp the actuality and composition of the ethical work that goes on in the configuration of a subject, one who is making a judgment about dying, with other participants and observers, the anthropologist included.

Abstract

Dans la majorité des pays membres du Conseil de l'Europe, il est illégal de pratiquer l'euthanasie active ou d'aider quelqu'un à se suicider. Après la décision de deux pays - les Pays-Bas, puis la Belgique - de modifier leur législation afin de permettre à un médecin de mettre fin à la vie d'une personne si certaines conditions sont réunies, on s'interroge dans d'autres pays européens sur l'opportunité de légaliser de tels actes. Cette question fait aujourd'hui l'objet de vifs débats, tant dans le public qu'au sein des milieux professionnels. Après l'analyse, dans un premier volume, des différents aspects éthiques et humains en présence dans le débat sur l'euthanasie, ce second volume aborde dans le détail la situation concrète et juridique dans huit pays européens et aux Etats-Unis, ainsi que l'état de la réflexion au niveau paneuropéen sur différents aspects de la fin de vie.
