Abstract

Il volume nasce dalla volontà di unire competenze e sensibilità diverse per posare lo sguardo sull’universo femminile “ristretto”, multiforme e nello stesso tempo dotato di una forte identità comune. L’attenzione si sofferma su fattispecie restrittive che rispondono a ragioni diverse, si consumano secondo modalità e tempi propri ed entro luoghi di esecuzione specificamente dedicati. Nessuna di esse, però, può legittimamente abdicare al corredo garantistico attraverso il quale l’art. 13 della nostra Costituzione dà sostanza all’inviolabilità della libertà personale. Tutte, invece, debbono rispettare il principio di eguaglianza, che non tollera il dissolversi forzato delle diversità sotto un trattamento ciecamente comune: la considerazione delle differenze di genere è una condizione essenziale della parità di genere. Nel volume s’incrociano modi diversi d’intendere tale differenza e di accostarsi ad essa nella valutazione dei presupposti e nella disciplina dei modi della restrizione della libertà personale nei confronti dell’universo femminile. Alcuni contributi retrospettivi s’incaricano di consentire uno sguardo sulle costanti e sulle variabili che hanno fino ad oggi segnato il cammino delle donne ristrette nel contesto italiano.

"The criminal population is composed of many types. It is composed of casual offenders who do not differ to any great extent from the ordinary man; it is composed of juvenile offenders; it is composed of insane, weakminded, and epileptic offenders; it is composed of habitual drunkards, beggars, and vagrants; and finally there is a distinct class consisting of habitual offenders against property. It is useless applying the same method of penal treatment to each and all of these classes of offenders. The treatment must be differentiated, and determined as far as practicable by the kind of criminal type to which the offender belongs. In order to effect this object, penal establishments must as far as possible be classified. Where classification of penal establishments is impossible, and where, in consequence, offenders of various types have to be incarcerated in the same establishment, these offenders should be classified in accordance with the type to which they belong, and subjected to a regimen adapted to their class. If these principles of penal treatment were applied to the criminal population it is certain that recidivism would diminish; it is certain that the habitual criminal would become a greater rarity, and, most important of all, it is certain that society would enjoy a greater immunity from crime. Millions of children in the United States have a parent who is incarcerated and a growing number of these nurturers are mothers. Disrupted Childhoods explores the issues that arise from a mother's confinement and provides first-person accounts of the experiences of children with moms behind bars. Jane A. Siegel offers a perspective that recognizes differences over the long course of a family's interaction with the criminal justice system. Presenting an unparalleled view into the children's lives both before and after their mothers are imprisoned, this book reveals the many challenges they face from the moment such a critical caregiver is arrested to the time she returns home from prison. Based on interviews with nearly seventy youngsters and their mothers conducted at different points of their parent's involvement in the process, the rich qualitative data of Disrupted Childhoods vividly reveals the lived experiences of prisoners' children, telling their stories in their own words. Siegel places the mother's incarceration in context with other aspects of the youths' experiences, including their family life and social worlds, and provides a unique opportunity to hear the voices of a group that has been largely silent until now.

Exploring the untold experiences of family members and friends caring for the children of female prisoners in England and Wales, this book sheds light on the collateral damage that incarceration causes those who take over caregiving responsibilities for the children of female prisoners. Providing new qualitative research on the lived experiences of caregiving relatives, alongside theoretically informed and policy-relevant insights, Booth shows the difficult and damaging consequences of the 'family sentence' they serve. Exploring the stigma, scarce statutory support and policy neglect they face, she offers much-needed evidence to encourage the development of a more inclusive, understanding and family-oriented justice system.

En plus, il y en a un qui est joli garçon, elles sont là : je vais me le faire… » « Cette surveillante, je lui disais tout. Elle amenait ses baskets, on faisait la course dans le couloir, on attendait que tout le monde soit enfermé. Ou elle me mettait sur le charriot et elle me poussait ! » « Y en avait une qui me passait des petits mots sous la porte le soir, une Anglaise : I love you Madame L. Alors à chaque fois je lui disais : non Margaret, non. » Pendant deux ans, la sociologue Myriam Joël a recueilli les confidences de 80 détenues et 70 professionnels et bénévoles officiant en détention féminine. Son enquête rapporte une parole étonnamment libre sur un sujet frappé d'illégitimité et ignoré des sciences sociales : la sexualité en prison de femmes. Ouvrant la perspective bien au-delà de son objet, tour à tour émouvant, drôle, dérangeant, l'ouvrage montre que l'univers carcéral n'a rien d'un isolat spatial et temporel. Comme à l'extérieur de la prison, la sexualité s'y révèle tout à la fois clandestine, invisible, ostensible et rationalisée. Les détenues y sont soumises aux mêmes injonctions contradictoires que les femmes du monde dit libre : s'affranchir de la domination/violence masculine tout en se conformant strictement aux normes de genre.
