[2nd ed.] In this, the second edition of Private International Law and the Internet , Dan Svantesson takes a fresh and original approach to what is perhaps the most crucial current issue in private international law; that is, how the Internet affects and is affected by the four fundamental questions: When should a lawsuit be entertained by the courts? Which state’s law should be applied? When should a court that can entertain a lawsuit decline to do so? And will a judgment rendered in one country be recognized and enforced in another? He identifies and investigates eleven characteristics of Internet communication that are relevant to these questions, and then proceeds with a detailed discussion of what is required of modern private international law rules. Dr Svantesson’s approach focuses on several issues that have far-reaching practical consequences in the Internet context, including the following: cross-border defamation; cross-border business contracts; cross-border consumer contracts; and cross-border trademark issues. A wide survey of private international law solutions encompasses insightful analyses of relevant laws adopted in a variety of countries including Australia, England, Hong Kong, the United States, Germany, Sweden, and China as well as in a range of international instruments. There is also a chapter on advances in geo-identification technology and its special value for legal practice. The book concludes with two model international conventions, one on cross-border defamation and one on cross-border contracts; as well as a set of practical check-lists to guide legal practitioners faced with cross-border matters within the discussed fields. Le droit international privé est confronté depuis près de trois décennies à un phénomène d’ampleur pour lequel il n’avait pas été pensé à l’origine : l’internet. À travers le réseau des réseaux, la discipline fait face à deux défis de taille, l’immatérialité et l’universalité des activités en ligne. À défaut de pouvoir localiser l’activité en ligne avec certitude, comment déterminer l’ordre juridique le plus proche de la situation ?L’adaptation des règles du droit international privé au contexte de l’internet, en l’absence d’intervention du législateur, incombe au juge. L’entreprise n’est toujours pas achevée et ses résultats demeurent pour l’instant largement insatisfaisants. On observe notamment une jurisprudence qui tend à limiter les inconvénients liés à la plurilocalisation des activités en ligne au moyen d’une approche dite « mosaïque », ce qui n’est autre qu’un retour au territorialisme le plus strict dans le cadre d’un réseau que l’on prétend pourtant a-territorial. Les défauts techniques de cette approche sont patents, en particulier du point de vue de la prévisibilité des solutions.Face au problème persistant de l’internet, on pourrait songer à mettre en œuvre une solution radicale : se concentrer uniquement sur la situation géographique des parties et, plus spécialement, sur le pays d’établissement du demandeur. Il apparaît en effet plus simple de localiser l’une des personnes impliquées dans l’activité en ligne, plutôt que l’activité en elle-même. La solution, toutefois, ne permet pas de concilier l’ensemble des intérêts en présence. La conciliation du droit international privé avec l’internet serait mieux réalisée en empruntant une autre voie, plus respectueuse du principe de proximité. Cette voie réside dans la prise en compte du lieu où l’activité en ligne litigieuse a son « impact le plus significatif », cela afin de localiser la situation juridique et de déterminer le droit applicable ou les juridictions compétentes. Reste encore à préciser comment identifier celui-ci. Les nouveaux outils de mesure d’audience géographique, à cet égard, peuvent jouer un rôle déterminant.L’ouvrage revient sur certains concepts-clés de la théorie générale du droit international privé, comme la localisation matérielle ou le principe de proximité, afin de formuler des solutions concrètes dans le domaine des activités en ligne.1er Prix André Isoré de la Chancellerie des Universités de ParisPrix de thèse de l’Université de Paris

Les textes étudiés dans cet ouvrage - Convention de Bruxelles du 27 septembre 1968, règlements 44/2001 et 1215/2012 - portent sur la compétence directe ainsi que sur la reconnaissance et l'exécution des décisions ; ils doivent assurer la réalisation d'un véritable « espace judiciaire européen » en matière civile et commerciale. Le règlement 1215/2012 (dit Bruxelles I bis) a apporté des modifications substantielles au règlement 44/2001. L'application de ces textes est guidée par une riche jurisprudence de la Cour de justice de l'Union européenne. Dans le cadre de l'AELE, les Conventions de Lugano de 1988, puis de 2007, ont adopté des systèmes « parallèles », d'abord à la Convention de Bruxelles de 1968 puis au règlement 44/2001. La Convention de 2007 est en vigueur entre tous les États de l'Union européenne, la Norvège, l'Islande et la Suisse.Cette cinquième édition, tenant compte de l'évolution des textes et de la jurisprudence, a pour ambition d'être utile non seulement aux universitaires (étudiants et enseignants) s'intéressant au droit international privé européen, mais aussi aux praticiens (magistrats, avocats, notaires) qui appliquent ces textes.
