Heinrich Zoepfl (1807-1877), Heidelberg Professor of Legal History and Constitutional Law, was active in the turbulent times of the "Vormärz", the "German Revolution" of 1848/49 and the foundation of the German Reich in 1870/71. He took an active part in all events, both in the lecture hall and through his writings, in the First Baden Chamber and in the Erfurt Union Parliament, as well as through widespread activity as an expert. As such, he advised the government in Karlsruhe, those affected by political repression, cities, parliaments and individuals, but especially numerous "mediatized" aristocratic houses, which not only had to cope with their loss of political power, but also had to solve many internal legal issues. Zoepfl was always involved as an expert on aristocratic professional law.For the first time, this volume presents a list of Zoepfls' unprinted and printed expert reports, commission reports, and works that can be found in Heidelberg University Library. Biographical details and an appreciation of his textbooks are followed by critiques of selected expert opinions, and historical outlines of the political situation in Zoepfl's lifetime.

1797 erscheint mit den Metaphysischen Anfangsgründen der Rechtslehre Immanuel Kants rechtsphilosophisches Hauptwerk. Nicht selten begegnet man daher der Auffassung, Kants Rechtsphilosophie entstamme im Wesentlichen seiner Spätphase und sei überdies nur schwer mit der kritischen Moralphilosophie der 1780er Jahre in Einklang zu bringen. Vor diesem Hintergrund widmet sich die vorliegende Untersuchung dem Vergleich des kantischen Rechtsbegriffs, wie er 1797 in der Einleitung in die Rechtslehre vorgestellt wird, mit Kants Ausführungen in den Vorlesungsnachschriften Moral-Mrongovius II und Naturrecht-Feyerabend aus dem Jahre 1784. Dabei kann nachgewiesen werden, dass der Rechtsbegriff von 1797 bereits 1784 ausgearbeitet war. Mehr noch: Es zeigt sich, dass Kants Rechtsbegriff nicht nur bereits in der Phase seiner kritischen Moralphilosophie vorlag, sondern vielmehr in einem Guss mit ihr konzipiert wurde und wie diese auf dem kritischen Freiheitsbegriff basiert.

There have been outsourcing and insourcing trends for decades. Most often benefits and costs of outsourcing are compared from the purely financial side. However, risks are those that eventually determine whether a particular product/service/asset should be outsourced or not. The aim of this chapter is to fill in the gap in the literature by analysing risk-reward or benefit-cost ratio in outsourcing decisions for services in the public and private sector. After comparing the process of strategic decision-making and pros and cons of outsourcing between the private and the public sector, a general rule of thumb is developed as a guideline for outsourcing decisions. The decision-making tree for outsourcing decisions is applicable to both typical outsourced services and outsourcing the implementation of complex projects. As a rule, the more complicated the service, the greater the chance of outsourcing. However, greater complexity of services is usually accompanied with higher risks, like in energy performance or public-private partnerships. Whenever the contract is not well prepared, outsourcing may not achieve the expected benefits and may enhance the costs and risks. Although some very specific cases cannot be generalised, the similarities in decision-making behaviour can be taken as guidance when opting for outsourcing possibilities.
