Marriage is at the center of one of today's fiercest political debates. Activists argue about how to define it, judges and legislators decide who should benefit from it, and scholars consider how the state should protect those who are denied it. Few, however, ask whether the state should have anything to do with marriage in the first place. In Untying the Knot, Tamara Metz addresses this crucial question, making a powerful argument that marriage, like religion, should be separated from the state. Rather than defining or conferring marriage, or relying on it to achieve legitimate public welfare goals, the state should create a narrow legal status that supports all intimate caregiving unions. With over half of Americans now in favor of marriage equality, it is clear that societal norms of marriage are being quickly redefined. The growing belief that the state may not discriminate against gays and lesbians calls into question whether the state may limit other types of marital unions, including plural marriage. While much has been written about same-sex marriage, as of yet there has been no book-length legal treatment of unions among three or more individuals. The first major study on plural marriage and the law, In Defense of Plural Marriage begins to fill this lacuna in the scholarly literature. Ronald C. Den Otter shows how the constitutional arguments that support the option of plural marriage are stronger than those against. Ultimately, he proposes a new semi-contractual marital model that would provide legal recognition for a wide range of intimate relationships.

Argues that cultural conceptions of children – and childhood – played a key role in legalizing gay marriage Legally Straight offers a critical reading of the legal debates over lesbian and gay marriage in the United States. The book draws on key judicial opinions to trace how our understanding of heterosexuality and marriage has changed. Upon closer inspection, it seemed that the cultural value of marriage was becoming tarnished and the trouble appeared to center on one very specific issue: reproduction. As opponents of lesbian and gay marriage emphasized the link between marriage and accidental pregnancy, the evidence mounted, the arguments proliferated, and resistance began to turn against itself. Heterosexuality, it seemed for a moment, was little more than a set of palliative prescriptions for the worst of human behavior, and children became the victims. It thus became the province of the courts to reinforce the cultural value of marriage by resisting what came to be known as the “procreation argument,” the assertion that marriage exists primarily to regulate the unruly aspects of heterosexual reproduction. Cultural conceptions of children and childhood were being put at risk as gays and lesbians were denied marriage, so that writing lesbian and gay families into the marriage law became the better option.

The generational and social thinking changes that caused an unprecedented shift toward support for gay marriageHow did gay marriage—something unimaginable two decades ago—come to feel inevitable to even its staunchest opponents? Drawing on over 95 interviews with two generations of Americans, as well as historical analysis and public opinion data, Peter Hart-Brinson argues that a fundamental shift in our understanding of homosexuality sparked the generational change that fueled gay marriage’s unprecedented rise. Hart-Brinson shows that the LGBTQ movement’s evolution and tactical responses to oppression caused Americans to reimagine what it means to be gay and what gay marriage would mean to society at large.
