The adoption of the Vienna Convention on the Law of Treaties in 1969 introduced the concept of jus cogens into the realm of the international legal order. The international community of States nevertheless decided to leave the determination of its substantive content to international Courts. While the International Court of Justice appears to have been reluctant to perform such a function, the Inter-American Court of Human Rights has developed a creative and dynamic method of interpretation intended to afford a full and complete protection to human beings; such an approach resulted inevitably in the identification of the content of peremptory norms. The Inter-American Court has therefore established a coherent system of rights and obligations where violations of jus cogens norms leads to the aggravated responsibility of the defendant State. The aim of this study is, on the one hand, to identify the factors…

Leading the reader through the darkened séance rooms and laboratories of Imperial and inter-war Germany, The Stepchildren of Science casts light on the emergence of psychical research and parapsychology in the German context. It looks, in particular, at the role of the psychiatrist Albert von Schrenck-Notzing - a figure who fashioned himself as both propagandist and Grand Seignior of German parapsychology - in shaping these nascent disciplines. In contrast to other recent studies in which occultism is seen as a means of dealing with or creating “the modern”, this book considers the epistemological, cultural and social issues that arose from psychical researchers’ and parapsychologists’ claims to scientific legitimacy. Focusing on the boundary disputes between these researchers and the spiritualists, occultists, psychologists and scientists with whom they competed for authority over the paranormal, The Stepchildren of Science demonstrates that in the German context both proponents and opponents alike understood psychical research and parapsychology as border sciences.

Practicing Progress focuses on the German Enlightenment in its dual manifestation as a cultural era and as a mode of discourse. The volume’s unifying theme is the promise and limitations of the Enlightenment, as seen from the twenty-first century. Contributors deal with figures from the eighteenth to the twentieth centuries in theology, poetry and drama, economic theory, and music. Included are such powerful critics of the politics of progress as Friedrich Nietzsche, Hannah Arendt, and Bertolt Brecht. The volume is of particular interest to scholars concerned with the complexity of literary phenomena. A variety of interpretive approaches yield fresh insights into the still ongoing project of Enlightenment.

Aesthetic Anxiety analyzes uncanny repetition in psychology, literature, philosophy, and film, and produces a new narrative about the centrality of aesthetics in modern subjectivity. The often horrible, but sometimes also enjoyable, experience of anxiety can be an aesthetic mode as well as a psychological state. Johnson’s elucidation of that state in texts by authors from Kant to Rilke demonstrates how estrangement can produce attachment, and repositions Romanticism as an engine of modernity.

This book reads messianic expectation as the defining characteristic of German culture in the first decades of the twentieth century. It has long been accepted that the Expressionist movement in Germany was infused with a thoroughly messianic strain. Here, with unprecedented detail and focus, that strain is traced through the work of four important Expressionist playwrights: Ernst Barlach, Georg Kaiser, Ernst Toller and Franz Werfel. Moreover, these dramatists are brought into new and sustained dialogues with the theorists and philosophers of messianism who were their contemporaries: Walter Benjamin, Ernst Bloch, Martin Buber, Hermann Cohen, Gershom Scholem. In arguing, for example, that concepts like Bloch’s utopian self-encounter ( Selbstbegegnung ) and Benjamin’s messianic now-time ( Jetztzeit ) reappear as the framework for Expressionism’s staging of collective redemption in a new age, Anderson forges a previously underappreciated link in the study of Central European thought in the early twentieth century.
