Abstract

Preventive detention shares many features with the quarantine measures sometimes employed in the context of infectious disease control. Both interventions involve imposing constraints on freedom of movement and association. Both interventions are standardly undeserved: in quarantine, the detained individual deserves no detention (or so I will assume), and in preventive detention, the individual has already endured any detention that can be justified by reference to desert. Both interventions are, in contrast to civil commitment under mental health legislation, normally imposed on more-or-less fully autonomous individuals. And both interventions are intended to reduce the risk that the constrained individual poses to the public. Yet despite these similarities, preventive detention and quarantine have received rather different moral report cards, with preventive detention attracting far greater criticism. One possible explanation for this is that many people implicitly endorse the view that preventive detention is always, in at least one respect, more morally problematic than quarantine. In this chapter I challenge that view by considering and rejecting six attempts to justify it, beginning with four attempts that I think can be easily dismissed, and proceeding to consider in more detail two attempts that are more resilient to criticism. Ultimately, I argue that all six attempts fail: preventive detention is not always more problematic, in one respect, than quarantine. I conclude by drawing out some implications of my argument. Of course, it does not follow from my argument that preventive detention is not in some cases more problematic than quarantine. A secondary purpose of this chapter, pursued in parallel to the first, is to identify the considerations that determine whether and when preventive detention is indeed in some respect more problematic.

Long description: Nach dem Karlsruher Urteil zur Sicherungsverwahrung, aber auch vor dem Hintergrund der lauter werdenden öffentlichen Diskussion, muss sich auch die Psychiatrie mit dem Thema sowie den Vorschlägen zur Neuordnung der Sicherungsverwahrung auseinandersetzen. Das Urteil fordert eine frühzeitige Therapie und Erprobung und rückt den Begriff der „psychischen Störung“ ins Zentrum für die Fortdauer der Sicherungsverwahrung, die es als dritten Sanktionsweg zwischen Strafhaft und psychiatrischem Maßregelvollzug bezeichnet. Damit werden zentrale Inhalte der Psychiatrie berührt. Dem wurde auch auf dem Jahreskongress der DGPPN in zahlreichen Veranstaltungen Rechnung getragen. Dieses Werk präsentiert die fachliche und wissenschaftliche Basis wie auch die Position der (forensischen) Psychiatrie in diesem Kontext und ist so eine wichtige Informations- und Entscheidungsgrundlage für alle, die in die Diskussion oder in die unmittelbare Gesetzgebung eingebunden sind. Abstract

Die Dissertation wird von dem Anliegen getragen, den Umgang der Gesellschaft mit gefährlichen Straftätern mit den Mitteln des Strafrechts (rechtsvergleichend für Deutschland und Korea) zu analysieren. Im Fokus steht hierbei insbesondere die Sicherungsverwahrung als Massregel der Besserung und Sicherung, wobei zu Beginn der Arbeit die Einbettung selbiger in das zweispurige System in den Blick genommen wird, am Ende der Schrift dann auch mögliche Alternativen beleuchtet werden. Im Ergebnis wird die Zweispurigkeit des Strafrechts und die Aufnahme der Massregeln der Besserung und Sicherung in das koreanische Strafgesetzbuch befürwortet, aber zugleich betont, dass der Schwerpunkt der strafrechtlichen Behandlung von gefährlichen Straftätern auf einer erfolgreichen Therapie und Resozialisierung liegen muss und dass insoweit nicht freiheitsentziehende Alternativen Vorrang besitzen sollten. The thesis analyzes a treatment of dangerous criminals on society with viewpoint of comparative criminal law in Germany and South Korea. In particular, with a focus on "preventive detention" as a "measure of improving and security", at first, basic theory of the Measure of Improving and Security is referred for the analysis of Preventive Detention. At the end of the thesis possible alternatives to Preventive Detention are reviewed. As a result, duality of the criminal law and Measure of Improving and Security will have to be acceptable to the Criminal Code, but the focus of the criminal treatment of dangerous criminals should also be successful treatment and re-socialization, alternatives that do not deprive of freedom emphasized to hold a dominant position.

Abstract

Preventive Detention and the Democratic State tracks the transformation of preventive detention from an emergency measure into an ordinary law enforcement tool in the democratic world. Historically, democracies used preventive detention only in the extraordinary circumstance in which the criminal justice system was impotent. They preferred criminal prosecution and its strict due process requirements to detaining people for a crime they may never commit. This book shows that major democracies have begun using detention as an insurance policy against dangerous people. In the process, they have embarked on a slippery slope that allows them to use preventive detention to bypass the criminal justice system. Already, detention has established a separate, inferior legal system for certain suspected criminals. Comparing preventive detention in India, England and the United States, the book brings to light its potentially dire consequences for the rule of law, due process rights and democratic principles based on the very real experiences of these countries.

Abstract

Most crimes of sexual violence are committed by people known to the victim-acquaintances and family members. Yet politicians and the media overemphasize predatory strangers when legislating against and reporting on sexual violence. In this book, Eric S. Janus goes far beyond sensational headlines to expose the reality of the laws designed to prevent sexual crimes. He shows that "sexual predator" laws, which have intense public and political support, are counterproductive.Janus contends that aggressive measures such as civil commitment and Megan's law, which are designed to restrain sex offenders before they can commit another crime, are bad policy and do little to actually reduce sexual violence. Further, these new laws make use of approaches such as preventive detention and actuarial profiling that violate important principles of liberty.Janus argues that to prevent sexual violence, policymakers must address the deep-seated societal problems that allow it to flourish. In addition to criminal sanctions, he endorses the specific efforts of some advocates, organizations, and social scientists to stop sexual violence by, for example, taking steps to change the attitudes and behaviors of school-age children and adolescents, improving public education, and promoting community treatment and supervision of previous offenders.Janus also warns that the principles underlying the predator laws may be the early harbingers of a "preventive state" in which the government casts wide nets of surveillance and intervenes to curtail liberty before crimes of any type occur. More than a critique of the status quo, this book discusses serious alternatives and how best to overcome the political obstacles to achieving rational policy.
