Abstract

Since the 1970s sexism in advertising has been the subject of many political and social discourses as well as the reason for social-scientific research. For the first time, the problem is analysed thoroughly in its legal dimensions. Based on social-scientific research and a critical analysis of the efficiency of the German Advertising Standards Authority the examination of the German constitutional law reveals in which regards gender-discriminating advertising violates constitutional rights and to what extent a legal prohibition of such advertising would be justified. Following a subsumption under European law the author analyses if the German UWG (Act Against Unfair Competition) is a possible instrument of regulation to ensure protection against gender discriminating advertising. The author substantiates that the UWG is to be interpreted value-related and assigns the constitutional assessments to the unfair competition law. The thesis concludes with a suggestion for a norm that contains the prohibition of gender-discriminating advertising to be implemented in the UWG.

Abstract

This series of publications presents the results of in-depth reviews of individual countries' national competition laws and policies.  Previously published in the now-discontinued Journal of Competition Law and Policy, these reviews assess how each country deals with competition and regulatory issues, from the soundness of its competition law to the structure and effectiveness of its competition institutions. Detailed background reports are peer reviewed before publication by the OECD Competition Committee, the OECD’s Global Forum on Competition, or the OECD/IDB Latin American Competition Forum. The reports, which typically incorporate recommendations for changes in government policy, quickly become part of national public debate, as they are closely analysed by government, the media and other influential commentators.

Abstract

Cette série de publications présente les résultats d’examens approfondis des législations et politiques nationales sur la concurrence de différents pays. Précédemment publiés dans la Revue de l'OCDE sur le droit et la politique de la concurrence qui a désormais cessé de paraître, ces examens évaluent comment chaque pays gère les questions relatives à la concurrence et à la régulation (solidité de la législation sur la concurrence, structure et efficacité des autorités de la concurrence). Avant publication, ces rapports de synthèse  détaillés sont examinés par le Comité de la concurrence de l'OCDE, le Forum mondial de l'OCDE sur la concurrence ou par le Forum mondial OCDE/BID sur la concurrence en Amérique latine. Ces rapports formulent généralement des recommandations sur les changements à apporter aux politiques gouvernementales et sont rapidement intégrés au débat politique national car ils sont attentivement analysés par le gouvernement, les médias et autres commentateurs influents.

Abstract

Shaping markets through competition and economic regulation is at the heart of addressing the development challenges facing countries in southern Africa. The contributors to Competition Law and Economic Regulation: Addressing Market Power in southern Africa critically assess the efficacy of the competition and economic regulation frameworks, including the impact of a number of the regional competition authorities in a range of sectors throughout southern Africa. Featuring academics as well as practitioners in the field, the book addresses issues common to southern African countries, where markets are small and concentrated, with particularly high barriers to entry, and where the resources to enforce legislation against anti-competitive conduct are limited. What is needed, the contributors argue, is an understanding of competition and regional integration as part of an inclusive growth agenda for Africa. By examining competition and regulation in a single framework, and viewing this within the southern African experience, this volume adds new perspectives to the global competition literature. Abstract

This open access book represents the first comprehensive, Australia-focused treatment of the problem of false election information disseminated for the purpose of gaining an electoral advantage. It explores cautious legal regulation as the most effective and decisive approach to the issue. In doing so, the book demonstrates that, although experiments with such remedies have met with mixed success elsewhere, they are nevertheless viable, especially in Australia where they have strong public support and are able to withstand constitutional challenge.
