Abstract

Even 30 years after the birth of the first "artificially produced baby Louise Brown in 1978, the desire for a child remains unfulfilled for many couples. Their hopes are to modern techniques of assisted reproduction. Reproductive medicine has since made enormous progress and opens up new opportunities. With these opportunities, however, are also linked new challenges, their moral and legal implications are considerable. Auch 30 Jahre nach der Geburt des ersten „Retortenbabys“ Louise Brown im Jahr 1978 bleibt für viele Paare der Wunsch nach einem eigenen Kind unerfüllt, und ihre Hoffnungen richten sich auf moderne Techniken assistierter Reproduktion. Die Reproduktionsmedizin hat seitdem immense Fortschritte gemacht und neue Chancen eröffnet. Mit diesen Chancen ist indessen zugleich eine Fülle neuer Herausforderungen verbunden, deren moralische und rechtliche Implikationen erheblich sind. Der vorliegende Band vereint Beiträge zweier Tagungen, die im Jahr 2007 vom »Forum für Ethik in der Medizin Frankfurt am Main e.V.« gemeinsam mit der »Arbeitsgruppe Reproduktionsmedizin und Embryonenschutz in der Akademie für Ethik in der Medizin« sowie vom »Zentrum für Medizinrecht« der Universität Göttingen veranstaltet wurden und welche die aktuelle Debatte um die Reproduktionsmedizin und ihre Möglichkeiten aufgreifen. Sie wenden sich den Errungenschaften und Problemen assistierter Fortpflanzung im Allgemeinen zu, widmen jedoch ihr Augenmerk speziell donogenen Techniken (Eizellspende, Samenspende, Embryospende) sowie dem Kinderwunsch in besonderen Situationen (etwa körperliche Behinderung, letale Erkrankung eines Partners, gleichgeschlechtliche Lebensgemeinschaften).

Abstract

This volume examines the impact of advances in genetics and assisted reproduction technologies on family law, human rights and the rights of the child, including the effects of international treaties on national legislation. It surveys the theoretical, ethical and legal discussions with regard to biotechnology and family law issues and the search for a balance between safeguarding respect for human rights and fundamental freedoms and the need to ensure freedom of research. However, biotechnology impinges not only on isolated individuals and their rights, but also on unborn children, the family as a network of living relationships and the basic structure of any society, as well as the foundation of parentage and kinship, social organization as a whole and, finally, mankind itself. As the attention of the World turns to cloning, this book will contribute to the search for a balance between the rights and freedoms of born and yet to be born human beings and the quest for new technologies.

Abstract

Thirty-five years after its initial success as a form of technologically assisted human reproduction, and five million miracle babies later, in virto fertilization (IVF) has become a routine procedure worldwide. In Biological Relatives, Sarah Franklin explores how the normalization of IVF has changed how both technology and biology are understood. Drawing on anthropology, feminist theory, and science studies, Franklin charts the evolution of IVF from an experimental research technique into a global technological platform used for a wide variety of applications, including genetic diagnosis, livestock breeding, cloning, and stem cell research. She contends that despite its ubiquity, IVF remains a highly paradoxical technology that confirms the relative and contingent nature of biology while creating new biological relatives. Using IVF as a lens, Franklin presents a bold and lucid thesis linking technologies of gender and sex to reproductive biomedicine, contemporary bioinnovation, and the future of kinship. -- from back cover.

Abstract

Tecnologie riproduttive e tutela della persona. This book emerged from the collaboration between the department of Biolaw of the University of Florence and the non-profit association Madre Provetta. It represents the first stage in a larger editorial project that aspires to contribute study and research to build towards a common European law on bioethics. The authors who have collaborated on this book are among the leading experts, in their respective fields, on questions raised by technologies of reproduction, which are here elaborated at both medical-scientific level and in their relation to sociology, bioethics, law and politics. The various contributions are divided into three specific thematic areas: liberty of reproduction and rights of the individual, pre-implant genetic diagnosis and the freedom and limitations of scientific research.
