This open access book discusses and analyses competing views and social implications of gestational surrogacy, which is making inroads as an option for parenthood as well as a work opportunity for women. It provides a rich account of transnational mobilizations for the abolition and regulation of surrogacy, with focus on United States, Italy and Mexico. La gestación por sustitución es una forma alternativa de acceder a la paternidad o maternidad, en el marco de las técnicas de reproducción humana asistida. Se trata de una práctica cada vez más frecuente, pues se estima que en la actualidad nacen unos veinte mil niños cada año como consecuencia de un acuerdo de este tipo. Esta obra expone la realidad de esta práctica, la gran cantidad de jurisprudencia nacional e internacional existente, las distintas opciones legales que recoge el derecho comparado y los conflictos que pueden suscitarse debido a la falta de regulación. Al mismo tiempo, propone una legislación que permita y regule explícitamente dicha práctica, que concilie los derechos en juego y sea acorde al interés superior del niño nacido bajo esas circunstancias. El libro analiza en profundidad la gestación por sustitución, sus orígenes, modalidades y tendencias, haciendo especial hincapié en los distintos tipos de familia que genera y en los importantes cambios que comporta en materia de filiación.
