Abstract

"Slavery and the Atlantic slave trade are among the most heinous crimes against humanity committed in the modern era. Yet, to this day no former slave society in the Americas has paid reparations to former slaves or their descendants. European countries have never compensated their former colonies in the Americas, whose wealth relied on slave labor, to a greater or lesser extent. Likewise, no African nation ever obtained any form of reparations for the Atlantic slave trade. Ana Lucia Araujo argues that these calls for reparations are not only not dead, but have a long and persevering history. She persuasively demonstrates that since the 18th century, enslaved and freed individuals started conceptualizing the idea of reparations in petitions, correspondences, pamphlets, public speeches, slave narratives, and judicial claims, written in English, French, Spanish, and Portuguese. In different periods, despite the legality of slavery, slaves and freed people were conscious of having been victims of a great injustice. This is the first book to offer a transnational narrative history of the financial, material, and symbolic reparations for slavery and the Atlantic slave trade. Abstract

The "Baltic Yearbook of International Law is an annual publication containing contributions on topical issues in international law and related fields that are relevant to Baltic affairs and beyond. In addition to articles on different aspects of international law, each Yearbook focuses on a theme with particular importance to the development of international law. Volume 3 contains contributions that were presented at, or inspired by, the conference entitled 'Reparations to States, Groups and Individuals: Implementation of State Responsibility' organised on the occasion of the inauguration of the Yearbook. Undoubtedly, there are many difficult legal and political questions surrounding the implementation of the law of State responsibility and this volume addresses only some of them. The contributions disclose several fundamental questions concerning the implementation of State responsibility. Can or should the general principles of State responsibility such as the obligation of full reparation be modified when applied within a specific framework of a treaty regime? Can or should these principles be modified when a treaty embodies rights that are generally considered to have achieved the character of jus cogens norms? How to enforce the obligation of reparations between States when one of them does not recognise any such obligation? One way or another all articles published in this volume raise the issue of ways and means to ensure the compliance of States with their international obligations and their responsibility in case of violations of these obligations.

Abstract

With the Holocaust resonating as the "thick background," historical redress processes in Israel render a particularly challenging case. The simultaneous concern the Jewish community has with past, present and future redress campaigns, as both victim and perpetrator, is unique. Who is Afraid of Historical Redress analyzes three cases of historical redress in Israel: the Yemeni children affair, the tinea capitis irradiations and the claims for the return of native land of the two Christian Palestinian villages of Iqrit and Bir'em. All three cases were redressed under the juridical edifice of legal thought and action. The outcomes suggest that these processes were insufficient for achieving closure by the victims, atonement by those responsible and reconciliation among social groups.
