Abstract

De tous les progrès récents de la biologie, ceux qui concernent le cerveau de l'homme comptent parmi les plus fascinants car il en dépend maintes attitudes philosophiques, éthiques et psychologiques. Ce livre s'adresse aux étudiants comme à tous ceux qui aspirent à connaître la véritable portée des progrès neuroscientifiques. La signification du libre arbitre a-t-elle évolué depuis qu'il est établi que l'activité mentale procède à la fois de l'hérédité et de l'apprentissage ? La douleur doit-elle être considérée comme une réaction de défense ou comme une sensation influencée par la culture ? La découverte de l'activité synthétique cérébrale en manière de réception sensorielle représente-t-elle un argument pour proclamer que la perception sensorielle diffère d'un individu à l'autre ? L'éthique en général, l'éthique médicale en particulier, n'échappent pas au débat philosophique qui cherche à reconnaître la part des mécanismes naturels et culturels. Cette "avant médecine du cerveau" peut être considérée comme un complément des Leçons sur la vie, la mort et la maladie (Hachette Littératures, 1998).

Abstract

This is the first book in healthcare ethics addressing the moral issues regarding ownership of the human body. Modern medicine increasingly transforms the body and makes use of body parts for diagnostic, therapeutic and preventive purposes. The book analyzes the concept of body ownership. It also reviews the ownership issues arising in clinical care (for example, donation policies, autopsy) and biomedical research. Societies and legal systems also have to deal with issues of body ownership. A comparison is made between specific legal arrangements in The Netherlands and France, as examples of legal approaches. In the final section of the book, different theoretical perspectives on the human body are analyzed: libertarian, personalist, deontological and utilitarian theories of body ownership.
