The consolidation of law and the development of legal writing during Spain's Golden Age not only helped that country become a modern state but also affected its great literature. In this fascinating book, Roberto González Echevarría explores the works of Cervantes, showing how his representations of love were inspired by examples of human deviance and desire culled from legal discourse. González Echevarría describes Spain's new legal policies, legislation, and institutions and explains how, at the same time, its literature became filled with love stories derived from classical and medieval sources. Examining the ways that these legal and literary developments interacted in Cervantes's work, he sheds new light on Don Quixote and other writings.

Abstract

Le nom de don Quichotte est connu dans le monde entier, mais un seul épisode subsiste généralement de son histoire, le combat contre les moulins à vent. Plus qu'à la somme de ses aventures, qui ne sont pas toutes marquées du sceau de la folie, l'ingénieux hidalgo semble devoir aujourd'hui sa renommée à sa maigre silhouette : fixée par Daumier, puis popularisée par Picasso, elle lui confère une apparence physique aussitôt reconnaissable. Mais en a-t-il été toujours ainsi ? De fait, les quatre siècles qui nous séparent désormais de sa naissance dessinent une trajectoire sur laquelle un retour s'imposait. Le présent essai montre comment ce personnage a acquis une audience universelle, à travers éditions et traductions, mais aussi au-delà du récit de ses exploits, grâce à des transpositions qui lui ont ouvert de nouveaux supports iconographie, théâtre, ballet, musique, cinéma, télévision. Il s'attache également à dégager les raisons qui éclairent la vitalité d'une figure ambiguë, à la fois sublime et dérisoire, qui est devenue une référence pour le roman moderne. Sterne, Dickens, Flaubert, Dostoïevski, Melville, Kafka, pour ne citer qu'eux, ont vu en Don Quichotte un texte fondateur. Ils ont contribué, chacun à sa manière, à mettre en œuvre le principe qui veut que plus le héros de roman s'applique à affronter le monde, plus celui-ci se dérobe ou se rebelle, creusant ainsi l'écart, comique ou tragique, entre le réel et sa représentation. Résumant dans son geste cette parabole épique, le Chevalier à la Triste Figure s'est détaché du livre dont il est issu. Il est devenu une figure mythique : plutôt qu'un message, un exemple qu'on est tenté de suivre, pour finir le plus souvent par s'en détourner.
