Abstract

This book portrays the achievements and progress of equality at work between men and women. The relevant UN Conventions, the ILO Philadelphia Declaration of 1944 and the numerous ILO Conventions and Recommendations on the development of equality are recalled. The European Union has applied and developed the universal ILO standards, empowering rights of equality with effective remedies through EU legislation and enforcement by its Court of Justice. The issues covered include equal remuneration and treatment, positive or affirmative action, dignity of the worker, maternity protection, part-time work and indirect discrimination, workers with family responsibilities and child care. New perspectives, policies and trends are discussed in a conclusion.

Abstract

There is still much to learn about fundamental aspects of employment discrimination law as a social system. What drives the growing demand for litigation? To what extent does discrimination persist in subtle but pervasive forms and what explains how it varies by organizational and market context? How do different groups of workers perceive the extent to which they are discriminated against and what, if anything, do they do about it? How have employers responded to discrimination law? How is employment discrimination law affected by broader political and legal currents? What is the relationship between anti-discrimination law and patterns of social inequality? Abstract

The importance of international maritime labour law - both as a component of international maritime law, and in socio-political and economic terms - has been recognised by the IMO International Maritime Law Institute for a number of years. Indeed, the Institute has annually organised a course on maritime labour law with the participation of inter alia the International Maritime Organization, the international Labour Organization, the International Transport Workers’ Federation, and the German Shipowners’ Association. It was therefore a great pleasure when the authors invited me to introduce their forthcoming monograph on Maritime Work Law Fundamentals: Responsible S- powners Reliable Seafarers. As the title suggests, a fundamental challenge of this branch of international maritime law is to achieve a balance between the interests of the two main stakeholders. Institutionally, the effort to achieve this balance dates back a number of decades with its genesis mainly found in the work of the International Labour Organization. It has to be said that whilst this effort achieved great progress, it has led to a haphazard, plethora of legal instruments.
