La réserve héréditaire ne choisit pas entre la dévolution testamentaire et la dévolution légale, ce qui la rend « d’analyse difficile » (Michel Grimaldi). On oppose souvent sa fonction familiale, la protection des proches, à sa fonction individuelle, assurer un équilibre entre les parts échues à chaque héritier. Ces observations mettent en évidence l’ambiguïté de cette institution, fruit du compromis opéré par les rédacteurs du Code civil entre la légitime des pays de droit écrit et la réserve des pays de coutumes. Mais cette rencontre entre les deux protections successorales en vigueur sous l’ancien droit n’est pas seulement le fait du Code civil. Elle remonte à l’adoption de la légitime par quelques coutumes au moment de leur rédaction officielle au xvie siècle. Entre le xvie et le xviiie siècle, le recours à la légitime se généralise en pays de coutumes. Elle s’adapte à la logique successorale de la réserve, tout en la transformant. La légitime coutumière devient alors une institution d’équilibre, tenant à la fois de la légitime romaine et de la réserve, où les rédacteurs du Code civil pourront trouver une synthèse originale des différentes traditions successorales de la France. Partant de la rédaction officielle des coutumes au xvie siècle, ce travail étudie l’arrivée progressive de la légitime en pays de coutumes, puis son évolution au contact de la réserve, jusqu’à sa consécration par le Code civil sous le nom de réserve héréditaire.

This report introduces findings from qualitative, case-study-based field research undertaken in late 2007 as part of a review of the work of Timap for justice (Timap), a not for-profit paralegal and advocacy organization in Sierra Leone. The analysis was intended to explain how and to what extent Timap has achieved its goals, in particular: 1) to help people achieve concrete solutions to justice problems; and 2) to increase the accountability and fairness of both traditional and formal governmental institutions. The primary audience for this report is Timap's directors and paralegals, though the data may also be useful to other paralegal organizations in developing nations, institutions with a focus on justice and rule of law, development institutions, and a wider audience with an interest in local-level justice.
