Abstract

The essays in this volume portrays the public debates concerning freedom of speech in the 18th century in France and Britain as well as Austria, Denmark, Russia, and Spain and its American territories. The economic integration of Europe and its offshoots over the past three centuries into a distinctive cultural product, 'the West,' has given rise to a triumphant universalist narrative that masks these disparate national contributions to freedom of speech and other liberal rights.

Abstract

Recounting controversial First Amendment cases from the Red Scare era to Citizens United, William Bennett Turner shows how we've arrived at our contemporary understanding of free speech. His strange cast of heroes and villains, some drawn from cases he litigated, includes Communists, Jehovah's Witnesses, Ku Klux Klansmen, the world's leading pornographer, prison wardens, dogged reporters, federal judges, a computer whiz, and a counterculture comedian. Figures of Speech offers a brief and insightful history of speaking up-and facing the consequences.

Abstract

In a stinging dissent to a 1961 Supreme Court decision that allowed the Illinois state bar to deny admission to prospective lawyers if they refused to answer political questions, Justice Hugo Black closed with the memorable line, ""We must not be afraid to be free."" Black saw the First Amendment as the foundation of American freedom--the guarantor of all other Constitutional rights. Yet since free speech is by nature unruly, people fear it. The impulse to curb or limit it has been a constant danger throughout American history. In We Must Not Be Afraid to Be Free, Ron Collins and Sam Chaltain,

Abstract

The first edition of Silencing the Opposition examined major challenges to the First Amendment using illustrative case studies of the various forms of governmental suppression in our history. The essays showed that governmental forces have used rhetorical strategies in simple and sophisticated ways to silence opponents. By studying which strategies are effective, how they evolve, and how they are unmasked, the authors offered a better understanding to combat the strategies in the future. This second edition of Silencing the Opposition includes: a revised introduction and conclusion, updated chapters, and two new chapters, one on the Patriot Act and one on habeas corpus of 'enemy combatants.' In these revisions and additions, Smith has arranged a valuable, timely collection appropriate for its focus on the last eight years of civil liberty reforms in the United States.

Abstract

Nunns examines how free speech became a centerpiece of American identity during the 20th century and how ideas of freedom of expression came to a head during the "Culture Wars" in the 1980's and '90s. He explores four case histories: performance artist Karen Finley and her court case revolving around public funding for the arts; the lawsuits involving the film I am Curious (Yellow); the controversy surrounding a community's performance of Angels in America; and the racist songwriting of David Allen Coe.
