Abstract

A Theory of Injustice : Philosophical and Literary Perspectives insists upon a re-thinking of Western theories of Justice. For 2500 years, philosophers have subordinated the concept of injustice to the concept of justice, as if injustice were only a secondary, derivative notion. This book summons literary classics, notably Shakespeare, to argue that injustice, not justice, should be the focus of our attention. A long line of thinkers, from Plato and Aristotle through to Kant, Hegel, Marx and Rawls, have overlooked the central problems of injustice. The book identifies two elements – unity and measurement – that are constantly assumed to be essential to justice. It shows how, in landmark literary classics, it is precisely those two elements that end up generating injustice. Western justice theory, it is concluded, cannot advance until it takes a new approach to the concept and the realities of injustice.

Abstract

La justice sociale est-elle possible ? Est-elle réalisable ? Pour répondre à cette question, Feriel Kandil entreprend une lecture critique des théories contemporaines de la justice, en s’appuyant sur les travaux de Ricoeur et de Weil. Une approche renouvelée de la justice sociale est ainsi proposée. Le premier moment de l’approche est pratique. Les principes de justice distributive qui rendent possible, en droit, la coopération entre citoyens démocratiques y sont identifiés : il s’agit de principes moraux au contenu formel. Le second moment est pragmatique. Il porte sur les conditions d’implémentation des principes. Ceux-ci servent de guides à l’action publique juste, c'est-à-dire à celle qui contribue, dans les sociétés contemporaines, au bien-vivre ensemble dans des institutions justes. Les conditions de possibilité de cette action sont identifiées : elles résident dans l’application des principes de justice distributive selon une logique de développement des capabilités et dans la mise en oeuvre complémentaire de principes de reconnaissance. L’ouvrage insiste sur le fait qu’une telle action n’est légitime que dans la mesure où il revient aux citoyens de débattre sur les choix de politiques publiques qu’il convient, en conséquence, de faire.

At least until the beginning of the 1990s, when the paradigm of recognition seemed to supplant the paradigm of redistributive justice theories, all the biggest contemporary political theories attempted to single out injustice in some form of inequality and tried in various ways to make individuals equal within a particular space for interpersonal comparison: whether this be the space of fundamental freedoms, income, wealth, conditions for self-respect, well-being, chances of well-being or capabilities. The objective of this work is to rebuild the main notions of equality and justice which have emerged from the contemporary philosophical-political debate and, at the same time, account for the critical theories that they have inspired, from the theories in which the language of difference adds to or surpasses the language of equality, to the paradigms located radically beyond all those regulatory positions which more or less explicitly arise from the liberal tradition, such as the paradigm of biopolitics, and that of cognitive capitalism.
