Abstract

La serie delle Epistole, Egloge, Questio de aqua et terra costituisce un gruppo di opere dantesche cosiddette "minori", che tali in realtà non sono, perché portano un contributo importante alla ricostruzione del profilo dell'Autore, culturale e biografico. In primo luogo le Epistole, quelle sopravvissute alla dispersione, che conservano la voce di Dante in situazioni o in rapporti umani molto delicati, a parte la XIII, testimonianza preziosa di un tentativo di autoesegesi della Commedia; cosí le Egloge, prova (unica) di raffinata composizione poetica in latino, che offrono un quadro commovente degli ultimi anni di vita del poeta; cosí anche la Questio, tardivamente conosciuta, documento dell'impegno teorico che ha sostenuto il pensatore fino all'estremo. Questa nuova edizione, che recupera i testi piú accreditati prodotti dalla moderna filologia dantesca, sottoposti tuttavia ad attenta revisione, correda il dettato di quelle opere di un denso apparato di note critiche e storiche, note esegetiche (a sostegno di nuove scrupolose traduzioni), di una vasta rete di Appendici di documenti integrativi del commento, che ne offrono, complessivamente, un'immagine del tutto nuova. Tale documentazione, opportunamente illustrata, porta elementi decisivi a conferma dell'autenticità di tutte le Epistole, compresa la XIII, e della Questio. Come in tutti i volumi della NECOD, un Sommario delle opere piú complesse (l'Epistola a Cangrande e la Questio) e un ampio Indice analitico del volume ne agevolano la lettura e la consultazione.

Abstract

In Dante and the Limits of the Law, Justin Steinberg offers the first comprehensive study of the legal structure essential to Dante's Divine Comedy. Steinberg reveals how Dante imagines an afterlife dominated by sophisticated laws, hierarchical jurisdictions, and rationalized punishments and rewards. He makes the compelling case that Dante deliberately exploits this highly structured legal system to explore the phenomenon of exceptions to it, crucially introducing Dante to current debates about literature's relation to law, exceptionality, and sovereignty. Examining how Dante probes the limits of the law in this juridical otherworld, Steinberg argues that exceptions were vital to the medieval legal order and that Dante's otherworld represents an ideal "system of exception." In the real world, Dante saw this system as increasingly threatened by the dual crises of church and empire: the abuses and overreaching of the popes and the absence of an effective Holy Roman Emperor. Steinberg shows that Dante's imagination of the afterlife seeks to address this gap between the universal validity of Roman law and the lack of a sovereign power to enforce it. Exploring the institutional role of disgrace, the entwined phenomena of judicial discretion and artistic freedom, medieval ideas about privilege and immunity, and the place of judgment in the poem, this cogently argued book brings to life Dante's sense of justice.

Abstract

In a celebratory moment of the Paradiso, Dante has Thomas go round the circle of sage spirits identifying each in turn in point of proper calling and confirming how it is that self is everywhere present to the other-than-self as a co-efficient of being in the endless and endlessly varied instantiation of that being. The image, at once perfectly Dantean and perfectly resplendent, underlies and informs these conversations of mine with Kenelm; for if in reading and rereading the cherished text, I have from time to time felt the need to enter a qualification, it is a matter here, as in the high consistory of paradise, of otherness as both contained and as authorized by sameness, as conditioned and set free by it for a life of its own. Never, in other words, is it a question in what follows of the stark alternativism of the sed contra, but instead a matter of formed friendship, of the kind of friendship which, conceived in love, makes for a sweet choreography of the spirit.
