Abstract

The conventional interpretation of equality under the law singles out certain groups or classes for constitutional protection: women, racial minorities, and gays and lesbians. The United States Supreme Court calls these groups 'suspect classes'. Laws that discriminate against them are generally unconstitutional. While this is a familiar account of equal protection jurisprudence, this book argues that this approach suffers from hitherto unnoticed normative and political problems. The book elucidates a competing, extant interpretation of equal protection jurisprudence that avoids these problems. The interpretation is not concerned with suspect classes but rather with the kinds of reasons that are already inadmissible as a matter of constitutional law. This alternative approach treats the equal protection clause like any other limit on governmental power, thus allowing the Court to invalidate equality-infringing laws and policies by focusing on their justification rather than the identity group they discriminate against.

Abstract

Legislating for Equality – a Multinational Collection of Non-Discrimination Norms is a compilation of constitutional provisions, penal code provisions and national laws on the prohibition of discrimination, racism and xenophobia. The book, divided into four volumes, offers a useful compendium for governmental and non-governmental agencies, civil rights practitioners and researchers, outlining the legal framework in all UN Member States on matters relating to discrimination on the basis of race, religion and ethnicity, prohibition of hate crimes and hate speech, and the protection of minorities. Each volume also includes relevant international and regional treaties and ratification tables. The first volume on Europe was published in August 2012. In this second volume, updated to 31 November 2012, we turn our attention to the Americas: North America, Latin America, and the Caribbean. During the past decade many American countries amended their constitutions and enacted laws protecting the rights of indigenous people.

Abstract

John Bingham was the architect of the rebirth of the United States following the Civil War. A leading antislavery lawyer and congressman from Ohio, Bingham wrote the most important part of the Fourteenth Amendment to the Constitution, which guarantees fundamental rights and equality to all Americans. He was also at the center of two of the greatest trials in history, giving the closing argument in the military prosecution of John Wilkes Booth’s co-conspirators for the assassination of Abraham Lincoln and in the impeachment of President Andrew Johnson. And more than any other man, Bingham played the key role in shaping the Union’s policy towards the occupied ex-Confederate States, with consequences that still haunt our politics. American Founding Son provides the most complete portrait yet of this remarkable statesman. Drawing on his personal letters and speeches, the book traces Bingham’s life from his humble roots in Pennsylvania through his career as a leader of the Republican Party. Gerard N. Magliocca argues that Bingham and his congressional colleagues transformed the Constitution that the Founding Fathers created, and did so with the same ingenuity that their forbears used to create a more perfect union in the 1780s. "The goal of philosophy is always the same, to assist men to understand themselves and thus to operate in the open, not wildly in the dark."--Isaiah Berlin This volume of Isaiah Berlin's essays presents the sweep of his contributions to philosophy from his early participation in the debates surrounding logical positivism to his later work, which more evidently reflects his life-long interest in political theory, the history of ideas, and the philosophy of history. Here Berlin describes his view of the nature of philosophy, and of its main task: to uncover the various models and presuppositions--the concepts and categories--that men bring to their existence and that help form that existence.
