Abstract

A vast and diverse body of EU law addresses an enormous range of environmental matters. This book examines a number of areas of substantive EU environmental law, focusing on the striking preoccupation of EU environmental law with the structure of decision-making. It highlights the observation that environmental protection and environmental decision-making depend intimately both on detailed, specialised information about the physical state of the world, and on political judgments about values and priorities. It also explores the elaborate mechanisms that attempt to bring these diverse decision-making resources to EU environmental law in areas including industrial pollution, chemicals regulation, environmental assessment and climate change.

Abstract

Contemporary environmental regulation is facing significant challenges. These challenges are varied, and include the search for economic efficiency, popular mistrust of experts and frequent observation of poor practical results. At EU level, criticisms of regulatory activity are compounded by the significant questions that surround the legitimacy of certain EU institutions and processes. This book examines a range of substantive EU environmental law and policy, and considers far-reaching endeavours to improve environmental regulation. One striking feature of contemporary EU environmental law is its wholehearted preoccupation with the structure of decision-making. This development, and some of the serious tensions that arise in the legal conditions for decision-making, form a major theme of this book

Abstract

"Wild Law - In Practice aims to facilitate the transition of Earth Jurisprudence from theory into to practice. Earth Jurisprudence is an emerging philosophy of law, coined by cultural historian and geologian, Thomas Berry. It seeks to analyse the contribution of law in constructing, maintaining and perpetuating anthropocentrism and addresses the ways in which this orientation can be undermined and ultimately eliminated. In place of anthropocentrism, Earth Jurisprudence advocates an interpretation of law based on the ecocentric concept of an Earth community that includes both human and nonhuman entities. Addressing topics that include a critique of the effectiveness of environmental law in protecting the environment, developments in domestic/constitutional law recognising the rights of nature, and the regulation of sustainability, Wild Law - In Practice is the first book to focus specifically on the practical legal implications of Earth Jurisprudence"--
