"Essays on the evolution of the post-apartheid state: Legacies, reforms and prospects is a compilation of research papers which are meant to generate strategic reflection beyond issues to do with the day-to-day chores of governance. The views across the essays may not be entirely consistent ; and the issues they raise may be contentious. This merely affirms the truism that the state is a contested terrain. The aim is to deepen the search for an understanding of the theory of the state as it applies to a transforming society such as ours, and to trudge the dividing line between theory and practice so they can feed into each other in a progressive spiral towards the desired ' end-state'. This book forms part of MISTRA's core research projects that were initiated at its founding some three years ago. Abstract

In this volume, fifteen contributors from the disciplines of law, politics and sociology reflect on South Africa's transition to democracy and the challenges of transformation and nation-building that have confronted the country since the first democratic elections of 1994. The range of topics covered is expansive, in keeping with a broader than usual definition of transitional justice which, it is argued, is more appropriate for states faced with the mammoth tasks of reform and institution-building in a context in which democracy has never been firmly rooted and the existence of widespread poverty gives rise to the dual demands for both bread and freedom. In the case of South Africa, the post-apartheid era has been characterised by wide-ranging attempts at transformation and nation-building, from the well-known Truth and Reconciliation Commission to reforms in education and policing, the promotion of women's rights, the reform of land law, the provision of basic services to hundreds of thousands of poor households, a new framework for freedom of expression, and the transformation of the judiciary. In the light of South Africa's commitment to a new constitutional dispensation and to legal regulation, this volume focuses in particular, but not exclusively, on the role that law and lawyers have played in social and political change in South Africa in the post-apartheid era. It sets the South African experience in historical and comparative perspective and considers whether any lessons may be learnt for the field of transitional justice.

Abstract

Historians often suggest that African elites were eclipsed by an era of mass politics and insurgency during the South African transition, trade unions and popular insurgency in townships seen as having dominated political life, with rural and regional forces perceived as secondary or disruptive. Yet across the continent, Native Reserves were often well-springs of African leadership in the mid-twentieth century, with political leaders such as Mandela usingregionally rooted clan, schooling and professional connections to vault to leadership. They crafted expansive nationalisms from these 'kin' identities, and regional elites were co-opted by settler governments, most notably into the Bantustans in South Africa. This history of Transkei during apartheid offers a new interpretation of the significance of ethnicity within African nationalism, uncovering the ambiguous connections between the nationalist elites, the chieftaincy and the Bantustan bureaucracy, and unraveling the complex relationships with the ANC. The author reassesses the Bantustans and the changing politics of chieftaincy, showing how local dissent within Transkei connected to wider political movements and ideologies. Emphasizing the importance of elite politics, he describes how the ANC-in-exile attempted to re-enter South Africa through the Bantustans drawing on elite kin networks. This failed in KwaZulu, but Transkei provided vital support after a coup in 1987, and the alliances forged were important during the apartheid endgame. Finally, in counterpoint to Africanist debates that focus on how South African insurgencies narrowed nationalist thought and practice, he maintains ANC leaders calmed South Africa's conflicts of the early 1990s by espousing an inclusive nationalism that incorporated local identities, and that 'Mandela's kinsmen' still play a key role in state politics today. Abstract

Violent Accounts presents a compelling study of how ordinary people commit extraordinary acts of violence and how perpetrators and victims manage in the aftermath. Grounded in extensive, qualitative analysis of perpetrator testimony, the volume reveals the individual experiences of perpetrators as well as general patterns of influence that lead to collective violence. Drawing on public testimony from the amnesty hearings of the South African Truth and Reconciliation Commission, the book interweaves hundreds of hours of testimony from seventy-four violent perpetrators in apartheid South Africa, including twelve major cases that involved direct interactions between victims and perpetrators. The analysis of perpetrator testimony covers all tiers on the hierarchy of organized violence, from executives who translated political doctrine into general strategies, to managers who translated these general strategies into specific plans, to the staff—the foot soldiers—who carried out the destructive plans of these managers. Vivid and accessible, Violent Accounts is a work of innovative scholarship that transcends the particulars of the Truth and Reconciliation Commission to reveal broader themes and unexpected insights about perpetrators of collective violence, the confrontations between victims and perpetrators in the aftermath of this violence, the reality of multiple truths, the complexities of reconciliation, and lessons of restorative justice.

Abstract

In 1994, the first non-racial elections in South Africa brought Nelson Mandela and his African National Congress to office; elections since have confirmed the ANC's hold, both popular and legitimate,on power. Yet, at the same time, South Africa has one of the highest rates of protest and dissent in the world - underscored by the police shooting of 34 striking miners at Marikana in 2012 - regionsof deep poverty and environmental degradation, rising inequality and high unemployment rates. This book looks at this paradox by examining the precise character of the post-apartheid state, and the roots of the hope that something better than the semi-liberation that the ANC has presided over must not be long delayed - both within the ANC itself and within the broader society of South Africa.
The authors present a history of South Africa from earliest times, with today's post-apartheid society interpreted and understood in the context of and through the lens of its earlier history. Following the introduction, which offers an analytical background to the narrative that follows, they track the course of South African history: from its origins to apartheid in the 1970; through the crisisand transition of the 1970s and 1980s to the historic deal-making of 1994 that ended apartheid; to its recent history from Mandela to Marikana, with increasing signs of social unrest and class conflict. Finally, the authors reflect on the present situation in South Africa with reference to the historical patterns that have shaped contemporary realities and the possibility of a 'next liberation struggle'.
