La possibilité de soigner un patient contre son gré est une spécificité de la psychiatrie. Chaque année en France, par nécessité, près de 80 000 patients sont traités pour leurs troubles mentaux sans y avoir consenti, pour des périodes plus ou moins longues. Les lois du 5 juillet 2011 et du 27 septembre 2013 ont profondément modifié le cadre, dérogatoire au droit commun, dans lequel des soins peuvent être dispensés sous cette forme.
