La possibilité de soigner un patient contre son gré est une spécificité de la psychiatrie. Chaque année en France, par nécessité, près de 80 000 patients sont traités pour leurs troubles mentaux sans y avoir consenti, pour des périodes plus ou moins longues. Les lois du 5 juillet 2011 et du 27 septembre 2013 ont profondément modifié le cadre, dérogatoire au droit commun, dans lequel des soins peuvent être dispensés sous cette forme. Elles visaient principalement à renforcer les garanties apportées aux malades pour leurs libertés individuelles et à établir un contrôle systématique du juge. Elles ont répondu aussi à une volonté des pouvoirs publics de protéger davantage la société des débordements pouvant être liés à certaines pathologies mentales. En 13 chapitres thématiques, toutes les dispositions autour des soins sans consentement en psychiatrie sont présentées. Les auteurs exposent la genèse et l'état actuel du droit, commentent la jurisprudence, en s'appuyant sur les données de la médecine psychiatrique et des bonnes pratiques professionnelles. Ils soulignent l'ambition de bientraitance aujourd'hui portée par la législation de santé mentale.
