Abstract

In this book, legal, biomedical, psychosocial, and social science scholars and practitioners offer the first comparative account of the increasing dependence on expertise in the asylum and refugee status determination process. This volume presents a comprehensive study of the relevance of experts, as mediators of culture, who are called upon to corroborate, substantiate credibility, and serve as translators in the face of confusing legal standards that require proof of new forms and reasons for persecution around the globe. The authors provide insights into the evidentiary burdens on asylum seekers and the expanding role of expertise in the forms of country-conditions reports, biomedical and psychiatric evaluations, and the emerging field of forensic linguistic analysis in response to emerging forms of persecution, such as gender-based or sexuality-based persecution.

Abstract

Exclusion from refugee status for the suspected commission of serious crimes is a topic fraught with political and legal controversy. This is an area which sees the intersection of refugee law with international criminal and humanitarian law and, increasingly, measures taken in the fight against terrorism. In this book, Sarah Singer examines whether and how terrorism has featured in the UK's interpretation and application of the Refugee Convention's exclusion clause. A number of sources are drawn on including questionnaires and interviews conducted with immigration judges, the Home Office's exclusion unit and legal practitioners. She therefore provides an unprecedented and thorough analysis of the UK's approach to asylum seekers suspected of serious criminality.

Abstract

Mediterranean states have developed various cooperation mechanisms in order to cope with the issues that arise from migration. This book critically analyses how institutional actors act and interact on the international scene in the control and management of migration in the Mediterranean. It highlights how, even though the involvement of 'universal' international organisations guarantees a certain balance in setting the goals of cooperation mechanisms and buttresses a certain coherence of the actions, the protection of migrants' fundamental rights is still an objective as opposed to a reality, and security imperatives and trends still prevail in the aftermath of the 2011 Arab Spring.

Abstract

Between the French Revolution and World War II, hundreds of thousands of Jews left the Jewish fold-by becoming Christians or, in liberal states, by intermarrying. Telling the stories of both famous and obscure individuals, Leaving the Jewish Fold explores the nature of this drift and defection from Judaism in Europe and America from the eighteenth century to today. Arguing that religious conviction was rarely a motive for Jews who became Christians, Todd Endelman shows that those who severed their Jewish ties were driven above all by pragmatic concerns-especially the desire to escape the stigma of Jewishness and its social, occupational, and emotional burdens.Through a detailed and colorful narrative, Endelman considers the social settings, national contexts, and historical circumstances that encouraged Jews to abandon Judaism, and factors that worked to the opposite effect. Demonstrating that anti-Jewish prejudice weighed more heavily on the Jews of Germany and Austria than those living in France and other liberal states as early as the first half of the nineteenth century, he reexamines how Germany's political and social development deviated from other European states. Endelman also reveals that liberal societies such as Great Britain and the United States, which tolerated Jewish integration, promoted radical assimilation and the dissolution of Jewish ties as often as hostile, illiberal societies such as Germany and Poland.Bringing together extensive research across several languages, Leaving the Jewish Fold will be the essential work on conversion and assimilation in modern Jewish history for years to come.
