Addressing one of the defining social issues of our time, The Politics of Gay Marriage in Latin America explores how and why Latin America, a culturally Catholic and historically conservative region, has become a leader among nations of the Global South, and even the Global North, in the passage of gay marriage legislation. In the first comparative study of its kind, Jordi Díez explains cross-national variation in the enactment of gay marriage in three countries: Argentina, Chile, and Mexico. Based on extensive interviews in the three countries, Díez argues that three main key factors explain variation in policy outcomes across these cases: the strength of social movement networks forged by activists in favor of gay marriage; the access to policy making afforded by particular national political institutions; and the resonance of the frames used to demand the expansion of marriage rights to same-sex couples.

"The UK's Civil Partnership Act 2004 and the Marriage (Same-Sex) Act 2014 are important legal, social and historical landmarks. For, beyond their practical implications, same-sex relationship recognition throughout the western world has become a key site of political contestation rich in symbolic, material and cultural meanings. While fiercely opposed by many, within mainstream narratives they are often represented as a victory in a legal reform process that commenced with the decriminalisation of homosexuality. For others, however, they represent a problematic and ambivalent political engagement with the institution of marriage. These reforms, then, provide an invaluable opportunity to engage with issues that arguably affect everyone, regardless of sexual orientation or relationship status. This collection brings together leading scholars and commentators from a wide range of professions and disciplinary backgrounds to critically reflect on the first ten years of the Civil Partnership Act and the introduction of same-sex marriage: some providing a close reading of their judicial interpretation, and their media representation; some locating them within the context of British political history and the history of sexuality; and some exploring their wider implications for struggles around homosexuality within the Commonwealth. There is massive public interest in same-sex marriage, a controversial topic that is rarely out of the media. This book investigates the extent to which legalizing same-sex marriage can contribute to ending the discrimination and social stigma faced by lesbian, gay, bisexual, and transgender men and women (LGBT) in the Western world. This issue breaks down into several further questions: can marriage equality be defended without reinforcing the idea that marriage is the most/only valuable form of intimate relationship? Can marriage equality be defended without further marginalizing non-conforming LGBT people? What kind of equality should LGBT people strive for? What critical agency might they lose when this equality is achieved? What institutional legacies should we embrace? The book focuses on human rights arguments supporting same-sex marriage and questions whether they are likely to both justify legal change and encourage shifts in the sociopolitical reception of LGBT people. After critically analyzing various arguments in favor of same-sex marriage, the author puts forward a justification that allows for marriage equality and does not result in the assimilation of queer identities into heteronormative identity.

The staggering string of victories by the gay rights movement's campaign for marriage equality raises questions not only about how gay people have been able to successfully deploy marriage to elevate their social and legal reputation, but also what kind of freedom and equality the ability to marry can mobilize. Wedlocked turns to history to compare today's same-sex marriage movement to the experiences of newly emancipated black people in the mid-nineteenth century, when they were able to legally marry for the first time. Maintaining that the transition to greater freedom was both wondrous and perilous for newly emancipated people, Katherine Franke relates stories of former slaves' involvements with marriage and draws lessons that serve as cautionary tales for today's marriage rights movements. While "be careful what you wish for" is a prominent theme, they also teach us how the rights-bearing subject is inevitably shaped by the very rights they bear, often in ways that reinforce racialized gender norms and stereotypes. Franke further illuminates how the racialization of same-sex marriage has redounded to the benefit of the gay rights movement while contributing to the ongoing subordination of people of color and the diminishing reproductive rights of women. Like same-sex couples today, freed African-American men and women experienced a shift in status from outlaws to in-laws, from living outside the law to finding their private lives organized by law and state licensure.
