Abstract

This book, first published in 1936, divides into roughly two parts: a re-examination of historical material; and a positive theory of causation suggested by the results of this re-examination. The historical study discloses an ambiguity in the meanings of causation and determinism; it discloses also that this ambiguity is transferred to the meaning of freedom.

Abstract

Rechtshandhaving is de verantwoordelijkheid van de overheid. Het 'sociaal contract' biedt overheidsbescherming aan burgers in ruil voor coöperatie aan de democratische samenleving. Dit monopolie leidt tot een verbod op eigenrichting: burgers mogen het heft niet in eigen handen nemen. In de democratische samenleving is dit immers niet gewenst en streng gereglementeerd.Sinds enkele decennia wordt er in het kader van zelfredzaamheid echter een gedeelte terug gelegd bij de burger, en is het omgaan met eigenrichting aan herijking toe is. Een tweede evolutie betreft de culturele eigenrichting. Het gaat hier om migrantengroepen die er concurrerende waarden- en normensystemen op na houden en wensen dat de rechtshandhaving plaatsvindt volgens geheel andere normen dan deze in het gastland. In welke mate kan afwijkende rechtshandhaving een plaats vinden in de democratische samenleving? Op deze vragen biedt dit Cahier antwoorden.

Abstract

In Walter Chatton on Future Contingents , Jon Bornholdt presents the first full-length translation, commentary, and analysis of the various attempts by Chatton (14th century C.E.) to solve the ancient problem of the status and significance of statements about the future. At issue is the danger of so-called logical determinism: if it is true now that a human will perform a given action tomorrow, is that human truly free to perform or refrain from performing that action? Bornholdt shows that Chatton constructed an original (though problematic) formal analysis that enabled him to canvass various approaches to the problem at different stages of his career, at all times showing an unusual sensitivity to the tension between formalist and metaphysical types of solution.
