Abstract

The most sophisticated theories of judicial behavior depict judges as rational actors who strategically pursue multiple goals when making decisions. However, these accounts tend to disregard the possibility that judges have heterogeneous goal preferences - that is, that different judges want different things. Integrating insights from personality psychology and economics, this book proposes a new theory of judicial behavior in which judges strategically pursue multiple goals, but their personality traits determine the relative importance of those goals. This theory is tested by analyzing the behavior of justices who served on the US Supreme Court between 1946 and 2015. Using recent advances in text-based personality measurement, Hall evaluates the influence of the 'big five' personality traits on the justices' behavior during each stage of the Court's decision-making process. What Justices Want shows that personality traits directly affect the justices' choices and moderate the influence of goal-related situational factors on justices' behavior.

Abstract

It is not hyperbole to proclaim that a crisis of legal legitimacy exists in the relationships between African Americans & the law & legal authorities & institutions that govern them. However, this legitimacy deficit has largely been documented through anecdotal evidence & a steady drumbeat of journalistic reports, but not rigorous scientific research. We posit that both experiences & in-group identities are commanding because they influence the ways in which black people process information, & in particular, the ways in which blacks react to the symbols of legal authority. Based on two nationally-representative samples, this text ties together four dominant theories of public opinion: legitimacy theory, social identity theory, theories of adulthood political socialization & learning through experience, & information processing theories.

Abstract

Originalism as Faith presents a comprehensive history of the originalism debates. It shows how the doctrine is rarely used by the Supreme Court, but is employed by academics, pundits and judges to maintain the mistaken faith that the Court decides cases under the law instead of the Justices' personal values. Tracing the development of the doctrine from the founding to present day, Eric J. Segall shows how originalism is used by judges as a pretext for reaching politically desirable results. The book also presents an accurate description and evaluation of the late Justice Scalia's jurisprudence and shows how he failed to practice the originalism method that he preached. Abstract

This book analyzes U.S. pro-insurgency paramilitary operations (PMOs) or U.S. proxy warfare from the beginning of the Cold War to the present and explains why many of these operations either failed entirely to achieve their objective, or why they produced negative consequences that greatly diminished their benefits. The chapters cover important aspects of what PMOs are, the history of U.S. PMOs, how they function, the dilemmas of secrecy and accountability, the issues of control, criminal conduct, and disposal of proxies, as well as newer developments that may change PMOs in the future. The author argues that the general approach of conducting PMOs as covert operations is inherently flawed since it tends to undermine many possibilities for control over proxies in a situation where the interests of sponsors and proxies necessarily diverge on key issues.
