Abstract

This book addresses the question of social constitutionalism, especially with regard to its role in the contemporary European project. For reasons of history and democracy, Europeans share a deep commitment to social constitutionalism. But in the contemporary European constitutional debate, constitutionalism and social democracy have become antagonists, with the survival of the one seeming to require sacrifice of the other. This book challenges the common view that constitutionalization means de-politicization. It argues that courts can exert a more indirect, creative, and agenda-setting role in the process of an ongoing clarification of the meaning of a right. The CJEU and the ECtHR - as courts beyond the nation state - are able to constructively re-open and re-politicize controversies that may appear settled at the national level in their constitutionalizing jurisprudence. And, crucially, our understanding of shared European constitutional principles is itself subject to revision and reconsideration as we accumulate experiences of dealing with diverse national contexts. 0By examining the jurisprudence of the CJEU and the ECtHR, the book demonstrates that in domain after domain, ranging from the protection of the vulnerable in the European social market to the guarantee of freedom of conscience, which in Europe emerged after many centuries of religious persecution, both courts can enhance and deepen democracy and thereby encourage the liberal project of constitutionalism beyond the state. Over time, once interpretive answers have become established in practice, courts can then move towards stronger forms of judicial intervention that consolidate best practice. It is this democratic and experimental process which lies at the heart of the distinctive model of contemporary Euroconstitutionalism.

Abstract

L'étude comparée de la jurisprudence des Cours européenne et interaméricaine des droits de l’homme en matière d’interprétation conventionnelle, comprise comme le processus, la recherche du sens à donner aux Conventions (et non son résultat) fait ressortir deux choses. Elle démontre tout d’abord l’inexistence d’une herméneutique commune. Si les Cours s’appuient sur la particularité des deux Conventions au regard du droit international général pour légitimer l’élaboration d’une démarche herméneutique spécifique, il existe de véritables différences méthodologiques entre elles. Elle révèle ensuite un mouvement de rapprochement des solutions jurisprudentielles adoptées, dont le rythme peut être comparé à celui d’une valse à trois temps. Le premier est marqué par le développement de l'herméneutique européenne ; le deuxième consiste en la reprise de ce patrimoine interprétatif par la Cour interaméricaine, qui l’adapte néanmoins à ses spécificités ; le troisième, enfin, consiste en une convergence de la jurisprudence des deux Cours, qui est bien souvent davantage le fait de la Cour européenne que celui de la Cour interaméricaine. Cette valse révèle un phénomène de syncrétisme interprétatif. Les Cours élaborent et réadaptent continuellement leur démarche à partir de la «fusion» de différentes «doctrines» ou «éléments culturels» dont elles s’enrichissent réciproquement, mais elle reste ancrée dans chaque système. Le syncrétisme, lui-même issu d’un double mouvement d’approfondissement de chaque système dans sa propre vision et d’ouverture sur d’autres, semble alors s’inscrire dans une certaine recherche de l’universel.

Abstract

Why has there been a human rights backlash in Russia despite the country having been part of the European human rights protection system since the late 1990s? To what extent does Russia implement judgments of the Strasbourg Court, and to what extent does it resist the implementation? Abstract

Core Socio-Economic Rights and the European Court of Human Rights deals with socio-economic rights in the context of the jurisprudence of the European Court of Human Rights (ECtHR). The book connects the ECtHR's socio-economic case law to an understanding of the Court's responsibility to recognize the limitations of supranational rights adjudication while protecting the most needy. By exploring the idea of core rights protection in constitutional and international law, a new perspective is developed that offers suggestions for improving the ECtHR's reasoning in socio-economic cases as well as contributing to the debate on indivisible rights adjudication in an age of 'rights inflation' and proportionality review.
